The plaintiffs challenge the lawfulness of fees charged by the federal government to access to records through the Public Access to Court Electronic Records program or “PACER.” The lawsuit claims that the fees are set above the amount permitted by statute and seeks monetary relief under the Little ▇▇▇▇▇▇ Act, 28 U.S.C. § 1346(a) in the amount of the excess fees paid. The government contends that all such fees are lawful.
