Bar Examination. A law school graduate will not be discharged solely for a first failure to pass the bar examination. TLDEF will provide one (1) month paid time off for those taking the bar for a second time. In the event a law graduate fails to pass the bar examination upon the second attempt, they will be transferred to an existing and open bargaining unit non-attorney position. The vacant non-attorney position must be one that the law school graduate meets the list of qualifications for as outlined in the job description. If the law school graduate is successful in passing the bar examination on a third attempt, upon admission to the bar, they will have recall rights to the job from which they were terminated for one (1) year following their date of termination, subject to hiring needs. Staff Attorneys who are rehired after passing the bar examination following termination after two bar failures will be given service credit for each month actually worked as a law school graduate prior to termination.

All law graduates (including staff admitted in another jurisdiction or jurisdictions but not in New York) required by NYLAG to be licensed to practice law in New York State shall be required to take the next available exam following commencement of their employment and/or their failure of the exam. Any employee who does not sign up and take the next available bar exam after failure shall be terminated, absent extraordinary circumstances, and such termination shall not be subject to Article 1.9
Bar Examination. Law Graduates shall be required to take the next Tennessee Bar Examination offered after their graduation for which they are eligible. If a Law Graduate fails to pass the Bar Examination the first time, the individual will be required to take the next Bar Examination offered. Unless waived by the Executive Director and/or designee for good cause shown, a Law Graduate shall be discharged upon failure to pass the second Bar Examination. Discharge for failure to pass the second Examination is not a grievable issue.

NYLAG will consider any such law graduate for any open, non-attorney bargaining unit positions, and will take their experience at NYLAG into account for any paralegal opening within such law graduate’s program, for which they meet the qualifications of the position. Employees taking the exam the second time, shall be given two weeks unpaid leave, for the purposes of studying for the second exam, in addition to using any other appropriate paid time off.

  • Health Examination The University will provide to each member of the bargaining unit a physical examination at the time of employment. Thereafter, an exam will be provided if required by the appropriate accrediting authority or the University or by statute. Staff members returning from medical or disability leave must present a note from the treating physician which indicates the date the staff member was able to return to duty and certifying the staff member’s fitness to return to work full duty. The University may, at its own cost and expense, have a physician of its choosing perform a physical examination of the staff member to ensure fitness and capability to return to work.

  • Eye Examinations For all covered EMPLOYEES required to use VDTs on average at least two (2) hours per day, the Department will provide a base line eye examination at the Occupational Safety and Health facility ("OSH"), followed by an eye examination at OSH once a year.

  • Medical Examination Where the Employer requires an employee to submit to a medical examination or medical interview, it shall be at the Employer's expense and on the Employer's time.

By submitting its quote, Contractor warrants that it has made all Site examination(s) that it deems necessary as to the condition of the Site, its accessibility for materials, workers and utilities, and Contractor’s ability to protect existing surface and subsurface improvements. No claim for allowance of time or money will be allowed as to any other undiscovered condition on the Site.
