Bar to Future Suits. Upon entry of the Final Approval Order and Judgment, the Settlement Class Representatives and Participating Settlement Class Members agree to refrain from, and to the fullest extent permitted by law shall be permanently barred and enjoined from instituting, directing or maintaining any lawsuit, contested matter, adversary proceeding, or miscellaneous proceeding against any of the Released Parties that relates to the Met Opera Data Security Incident or otherwise arises out of the same facts and circumstances set forth in the operative complaint in this Action, and shall be enjoined from prosecuting any claim they have released in the preceding Paragraphs, including the Released Claims, in any proceeding against any of the Released Parties or based on any actions taken by any of the Released Parties that are authorized or required by this Agreement or by the Final Approval Order and Judgment. Likewise, the Met Opera and its representatives, officers, agents, directors, affiliates, employees, insurers, and attorneys shall be enjoined from prosecuting any claim they have released in the preceding Paragraphs in any proceeding against the Settlement Class Representatives and Class Counsel or based on any actions taken by the Settlement Class Representatives and Class Counsel that are authorized or required by this Agreement or by the Final Approval Order and Judgment. It is further agreed that the Settlement may be pleaded as a complete defense to any proceeding subject to this section.
