Common use of Baseline Report Clause in Contracts

Baseline Report. The tank closure report and any other assessment of the Leased Premises required by the Environmental Agency shall be deemed the “Baseline Report” for the Leased Premises, and shall be dispositive of the presence and levels of soil and/or groundwater contamination caused by ▇▇▇▇▇▇’s use of the Leased Premises (“Covered Contamination”). Tenant also may, at its option, perform further investigation of the Leased Premises, which investigation shall be deemed part of the Baseline Report.
