Unrecovered Basic Charges & Authority to Settle Costs Claim It is possible that there will be a shortfall between our basic charges and the sum we recover on your behalf from the Defendant if the claim is successful. On assessment the Court will not award you the recovery of any costs which it considers to be “solicitor/client” in nature, nor will it normally allow costs which it considers are not proportionate to the amount of damages in dispute nor those it considers unreasonably incurred. Furthermore, it is likely that the Court will award you costs in accordance with the “summary assessment guideline hourly rates” which are currently as follows: Grade A - £255.00 per hour, Grade B - £218.00 per hour, Grade C - £177.00 per hour and Grade D - £126.00 per hour and were previously as follows Grade A - £201.00 per hour, Grade B - £177.00 per hour, Grade C - £146.00 per hour and Grade D - £111.00 per hour All of these factors will mean that it is unlikely that you will recover our basic charges in full from the Defendant. You should note that a Court assessment of your recoverable legal costs can be expensive and place you at a risk of having to pay the Defendant’s costs of the assessment proceedings if you do not better an offer they make to settle your costs claim. Basic Charges. (i) Circuits which will range in capacity from DS-ls to DS-3s shall be charged on a monthly basis. In some cases the monthly rate may not be mileage sensitive and a single recurring rate element may apply. For rates that are mileage sensitive the recurring charge shall include two rate elements, the "first mile" and "additional miles". The rates may be decreased for additional Circuits between the same two points of a Link for the same Purchaser. The charge for Circuits may vary by state and by city. The Purchaser must provide an unrestricted POTS line either near the IDU at one end of the link or at one mutually-agreeable point in a network of connected links at no charge to ART.
(ii) If the rate is mileage sensitive, a "first mile" rate element will be charged for each Circuit. Mileage is based on air miles between the two ▇▇▇▇. The "additional miles" rate element, if applicable, will be charged per Circuit for each mile of the link or part of a mile after the first mile.

Basic Charges. FluoroPharma shall pay to PureTech the sum of $3,750 per month (the "Basic Charges") for the use of (i) two (2) furnished offices (the "Offices") in the Office Suite, (ii) two (2) telephones, (iii) working telecommunications lines in each Office, (iv) conference rooms located within the Office Suite to the extent such conference rooms are not otherwise reserved or in use and (v) the kitchen facility in the Office Suite. PureTech shall select the location and size of such Offices in its sole discretion. PureTech shall make the Offices available for use in a heated, lighted and clean condition. FluoroPharma shall pay the Basic Charges in advance on the first day of each month during the Term (as defined below).
