BASIS FOR COVERAGE. We agree to pay the covered costs to repair or replace the items listed as covered in your Agreement Coverage Summary if any such items become inoperable during the term of this Agreement due to mechanical failure caused by routine wear and tear, subject to the terms and conditions of this Agreement. Determination of coverage for any claim will be made solely by us, considering but not limited to, our independent contractor’s diagnosis.

BASIS FOR COVERAGE. This Contract has been issued to the Contractholder on behalf of the eligible Employees and their eligible Dependents. The eligibility requirements, Contract Effective Date, Enrollee's Effective Date, and termination date of coverage stated in this Contract, are coincident to and consistent with the provisions set forth in the Contract. The Employees to be covered, any Employee Waiting Period that applies, premium classes and the plan of benefits are in accordance with the Contractholder's Master Group Application to the Corporation. Employee and Dependent premium shall be on a contributory or non-contributory basis as specified in the Contractholder's Master Group Application to the Company.

All repairs/replacements are subject to the terms and conditions of this Agreement. Determination of coverage for any claim will be made solely by us, considering but not limited to, our qualified service provider’s diagnosis. We reserve the right, at our option, to replace items rather than repair them. The definitions of the specific items that may be listed on your agreement as covered, as well as other limitations on coverage and other terms and conditions, are listed below. This Agreement covers only mechanical failures relating to the mechanical parts and components of those domestic-grade items that were in the home and in proper operating condition on the Agreement effective date. “Domestic-grade” items are those that were designated by the manufacturer, manufactured and marketed solely for installation and use in a residential single-family dwelling. “Mechanical failure” occurs when a covered item becomes inoperable and unable to perform its designed function, subject to the limitations and conditions set forth herein. We will cover an unknown pre-existing mechanical failure provided the failure could not have been detected by visual inspection or simple mechanical test. A visual inspection of the covered item is considered to mean the viewing of an item to verify that it appears structurally intact and without damage or missing parts that would indicate inoperability. A simple mechanical test means the ability to turn the unit off and on verifying the item operates without irregular sounds or smoke that may indicate a problem. In certain instances, we may require documentation from you during a claim review. Mechanical failure due to rust and corrosion is covered after the agreement effective date. The covered item will be deemed to have been in “proper operating condition” on the Agreement effective date if it was correctly located within the home, was properly installed to code at the time of installation, was fully connected, was capable of successfully performing all operations commensurate with the manufacturer’s original design intention, and did not pose any hazard to life or property. BASIS FOR COVERAGE. During the term of this Agreement, we agree to pay the covered costs to repair or replace the items listed as covered on your Agreement Coverage Summary if any such items become inoperable due to mechanical failure caused by normal wear and tear. Determination of Coverage including the operational condition as of the Agreement effective date for any claim will be made solely by us, considering but not limited to, our independent contractor’s diagnosis, hereinafter referred to as the “Service Contractor”. This Agreement does not cover any known or unknown pre-existing conditions. It is understood that WE ARE NOT A SERVICE CONTRACTOR and is not itself undertaking to repair or replace any such systems or components. This Agreement covers single-family homes, new construction homes, condominiums, townhomes, and mobile homes under 5,000 square feet, unless an alternative dwelling type (i.e. above 5,000 square feet or multi- unit home) is applied, and appropriate fees are paid. This Agreement will not cover systems or appliances within (a) commercial properties;

BASIS FOR COVERAGE. For insurance policies other than the professional liability insurance policy (if required), coverages shall be maintained without interruption during the Term. Notwithstanding the foregoing, coverage for claims for damages because of bodily injury, sickness or disease, or death of any person other than Grantee’s employees or claims for damages insured by usual personal injury liability coverage shall be written on a combined single limit coverage for bodily injury and property damage on an occurrence basis, and any excess/umbrella coverage shall also be on an occurrence basis in excess of such coverage.

BASIS FOR COVERAGE. Unless otherwise agreed to in writing, all claims must be made between the date of contract com- mencement at noon and the date of expiration at midnight. This contract covers mechanical break- downs to covered items as specified herein. The Contract Holder is entitled to service beyond the date of the warranty’s expiration so long as the claim has been filed within the warranty period. The Contract Holder may be offered a renewable contract in the form of a renewal notice in the month preceding the expiration of their contract. Contract Holders who renew their existing home warranty contract with RWS will receive a renewal discount off of current rates. For more information regarding renewal of your contract, please call RWS at 1-800- ▇▇▇-▇▇▇▇. This contract covers only items as described and excludes all others. All repairs will be made/offered in a manner determined by RWS. RWS shall have the sole option of determining in what manner mechanical breakdowns will be corrected. Contract Holder has the option of taking a cash payment in lieu of repair on any claim; a decision that must be made after diagnosis and approval of the claim by RWS and before any repairs have commenced and/ or parts have been ordered on their behalf. There are no optional coverages with the Simple Warranty by RWS except the pool/spa and septic tank contract optional add-ons. In other words, your contract includes all components as listed in this contract without paying any additional fees. The coverage in this contract applies only to items falling within the perimeter of the foundation of the home and attached garages with the exception of air conditioning units and well pumps. This contract only applies to homes on permanent foundations. Each and every distinct breakdown of any part or component of any covered mechanical system, as determined by an authorized contractor, constitutes a distinct claim for which the Contract Holder will be responsible for a Service Call Fee or the actual cost, whichever is lower. The Service Call Fee is payable to the contractor at time of service unless otherwise specified by RWS.

This Contract does not cover any known or unknown pre-existing conditions. It is understood that WE ARE NOT A SERVICE CONTRACTOR and We are not Ourselves undertaking to repair or replace any such systems or components. This Contract covers single-family homes, new construction homes, condominiums, townhomes, and mobile homes under 5,000 square feet, unless an alternative dwelling type (i.e. above 5,000 square feet or multi-unit home) is applied and appropriate fees are paid. This Contract will not cover systems or appliances within (a) commercial properties; (b) residential properties used for business purposes including, but not limited to, dwellings used for rest homes, day care centers, schools and/or professional offices; (c) common areas of condominiums, multi-family houses and/or cooperatives; (d) vacant properties; or (e) foreclosed/short sold properties. Coverage applies to the systems and components mentioned as "covered" in accordance with the terms and conditions of this Contract so long as such systems and components: A. Become inoperable due to normal wear and tear; B. Are in place and in proper working order on the effective date of this Contract; and C. Are located inside the confines of the main foundation of the home or attached or detached garage, with the exception of the air conditioner, exterior pool/spa, septic system, and well pump.
