Benchmark Replacement Setting Sample Clauses

The Benchmark Replacement Setting clause defines the process for selecting a new reference rate if the original benchmark used in a contract becomes unavailable or is no longer reliable. Typically, this clause outlines the criteria and procedures for identifying and implementing a suitable replacement benchmark, such as specifying fallback rates or designating a party responsible for making the selection. Its core practical function is to ensure continuity and reduce uncertainty in contractual obligations by providing a clear mechanism for adapting to changes in financial benchmarks.
