Common use of Benefit Coverage During Leave of Absence Clause in Contracts

Benefit Coverage During Leave of Absence. ‌ (a) The parties to this agreement recognize and agree that except where specific arrangements are made as provided in this agreement, all benefits and entitlements provided by this agreement are suspended for an employee who is absent on leave of absence without pay in excess of 30 days. (b) Where an employee has been granted an approved leave of absence without pay, in excess of 30 accumulated calendar days, and the employee has been participating in the following benefit coverage: • group life insurance; • accidental death and dismemberment benefit; • dental plan; • extended health care; or • Medical Services Plan of BC, the employee may maintain coverage in those plans. The employee must pay 100% of the premiums for this coverage during such leave. The Employer will continue to remit premiums on behalf of such employees. Mutually acceptable arrangements for repayment of the employee's portion will be made in advance of the commencement of the leave. Failure by the employee to effect payment of the premiums may result in loss of coverage. (c) For an employee who is disabled during the leave of absence, and who is unable to return to work on the previously agreed-to date of return from leave, the provisions of Clause 18.1 (Sick Leave) apply. (d) Employees who are unable to work due to a workplace injury or illness and who are on a recognized WorkSafeBC claim or who are in receipt of sick leave, short term disability plan or LTD benefits will not be considered to be on a leave of absence without pay for the purposes of this clause.
