Betterment. If the Consultant failed to include a component(s), or if during construction it is discovered a component(s) is required that was not in the Consultant’s original plans or specifications, and that the component(s) is necessary to complete a satisfactory project, the Consultant shall not be responsible for paying the cost required to add such component(s) to the extent that such component(s) would have been required and included in the original construction documents. 10.1 In no event shall the Consultant be responsible for any cost or expense that provides betterment or that upgrades or enhances the value of the Owner’s project if the component should have originally been included in the construction drawings and/or specifications.
