BID PREFERENCE. In accordance with the Minority Women Owned Business Enterprise (MWBE) Ordinance, award of a contract resulting from this Invitation for Bids may be made to the lowest responsive and responsible Orange County certified MWBE bidder provided that the bid does not exceed the overall lowest responsive and responsible bidder by the following percentages for the bid amounts listed: A. 8% - Bids Up To $100,000 In accordance with the Registered Service Disabled Veteran Business Ordinance, award of a contract resulting from this Invitation for Bids may be made to the lowest responsive and responsible registered prime Service Disabled Veteran bidder provided that the bid does not exceed the overall lowest responsive and responsible bidder by the following percentages for the bid amounts listed: A. 8% - Bids Up To $100,000 A. OVERVIEW: 1. Lack of resources by the deceased and the inability to locate relatives of the deceased, 2. Relatives unable or unwilling to handle the financial responsibility to bury or cremate the body. The technical specifications described herein are in compliance with Orange County Administrative Regulations, No. 11.01.01, 08/21/01, Burial and Cremation Service. A copy is provided as Attachment A. If the Division determines that a referred decedent, in the actual or constructive possession of the Contractor or Orange County Medical Examiner’s Office, has resources or assets sufficient to cover necessary costs for burial or cremation services, or has family members or others who are willing to accept financial responsibility, the Division may refer the interment or cremation to the Contractor for final disposition of the remains as a private matter. The Division shall make final determination of eligibility for payment and to arrange for the disposition of a body referred to the Division requiring cremation or burial at public expense. The Contractor may subcontract all or any part of the required services, provided all subcontractors meet the minimum requirements for subcontractors, according to the Orange County Procurement Division, and the primary Contractor remains responsible for the performance of all services and activities in regard to this contract. The Contractor shall promptly refer any potential claiming party to the Division’s representative. If the decedent’s relatives or friends assume the financial responsibility, they may select any funeral or cremation service provider of their choice. Upon receipt of written notice from the Division, the Contractor shall release an otherwise eligible decedent’s remains to any other licensed funeral service provider. The County will pay the Contractor for services rendered and authorized in writing by the Division through submission of a delivery order, which remain unpaid by the claiming party. Any request to transfer a body shall be referred to the Division’s representative. The County shall not provide services or make payment for anyone who did not die in Orange County, regardless of the County of residency while alive.
