BID PROCEDURE. When a vacancy occurs in the District in any bargaining unit classification, and the Board decides to fill the position, it shall be posted on the staff bulletin board in all school building offices or Board-owned facilities for a period of five (5) work days. After three (3) work days the employee in the new bid position and the administration shall meet with an OAPSE representative to discuss job performance progress, if requested. 5. The Superintendent shall have the authority to determine the feasibility of an employee combining one position with another. The Superintendent may not combine positions due to increased costs of benefits or may receive waiver of benefits should the employee agree to accept the position. All combined position employees as of June 11, 1992, receiving benefits will be excluded from this provision. 6. Excluded from the bargaining unit are employees employed specifically to assist students on an as needed basis as a requirement of an Individual Educational Plan (IEP). 7. If an employee accepts a “combined” position (i.e., when the employee holds two (2) or more jobs in the District), the total hours for a week for the combined positions cannot exceed twenty-nine (29) hours. This restriction only applies to individuals hired into a “combined” position after July 1, 2014. Bargaining unit members are not eligible to accept a “combined” position if receipt of the additional job would cause his/her regularly assigned hours for the combined positions to exceed twenty-nine (29) hours per week. If no present employee bids the vacant position or is qualified, the position can then be offered to other qualified applicants. Determination of qualifications is the decision of administration based on the job description for the combined positions vacant position. Any contractual position that permanently increases by thirty (30) minutes or more shall be posted and filled through the procedure outlined in this Article. All vacancies shall be filled within thirty (30) working days of the closing of the bids, unless there are no qualified candidates or the Board determines not to exceed twenty-nine fill the position in accordance with Article 16 of this Agreement. BID PROCEDURE. A. When a vacancy occurs in a classification covered under this Agreement, the District in any bargaining unit classificationSuperintendent shall cause to be posted a notice of such vacancy. BID PROCEDURE. A. All vacancies shall be filled within thirty (30) workdays following the expiration of the bidding period unless extended by mutual agreement. An employee’s disciplinary record can be included as minimum qualifications to bid for a posted position. An employee’s disciplinary record will not prohibit an employee from bidding on a demotion. The records from 12-1-86 and thereafter shall only be used. C. D. Unsuccessful bidders may request information regarding non-selection for purposes of future promotability. The employee may file a grievance based on a mistake in facts. E. Upon return to work, the employee shall verify the job bid with the Human Resources Department. F. If the Employer does not plan to fill a vacancy, the Union shall be notified in writing. G. When an employee successfully bids into a promotional position, he or she shall earn the higher rate of pay on the first date the employee assumes the duties of the position. H. When an employee successfully bids into a demotion position, he or she shall earn the lower rate of pay on the first date the employees assumes the duties of the position. I. This posting and bidding procedure pertains to all positions in the bargaining unit. J. The successful bidder shall serve a one hundred twenty (120) calendar day probationary period. During an employee’s initial/new hire probationary period, the employee may not be permitted to bid. In addition, the employee shall not be eligible to bid as set forth in this Article while he or she is serving a promotional or transfer probationary period. Should no qualified employees bid, preference shall be given to the senior employee in the trainee position. BID PROCEDURE. SECTION 15.1 As hereinafter provided, seniority shall apply in the event of appointments made by the Board of Education to vacant positions within the bargaining unit. SECTION 15.2 Overall seniority shall be defined as the length of service by an employee as computed from the most recent date of hire in the Scioto Valley School District. Classification seniority shall be defined as the length of service by an employee as computed from the most recent successful date of bid. The Board shall provide, upon request, a current seniority list to the Union by October 1st of each year. The list shall contain the employees’ dates of hire, classifications, and hourly rates of pay. SECTION 15.3 Vacant positions shall be defined as an existing job or newly created job for which there is no permanent employee. SECTION 15.4 When the Board determines that a vacancy occurs in the District in any bargaining unit classificationwill be filled, and the Board decides this bid procedure shall apply to fill the positionall vacant jobs, it existing or newly created, including all vacant bus routes. SECTION 15.5 All work locations shall be posted on the staff bulletin board in all school building offices or Board-owned facilities for a period of five (5) days with a notice indicating any vacant positions (a day shall be defined as a work daysday excluding Saturdays, Sundays and holidays) and also a notice of all such vacant positions given to the OAPSE President. All postings shall include the following information: position, building or route area, hours of work, number of workdays per year, and last day to apply for the position. Bus driver postings shall include: route area, initial pick-up and last drop-off times, and approximate number of students on the bus. Information contained in the posting is merely to afford the employees with information concerning the position at the time of the posting. C. Secretarial positions shall be filled based on qualifications as listed on the job description, education, and experience. All Applicants shall be required to pass a skill assessment test to be deemed qualified. Seniority shall be the determining factor when the criteria listed in this Section (C) are deemed equal. D. If no bargaining unit employee bids on a vacant position and the Board elects to fill the position from outside the bargaining unit, the Board will fill the position no later than the second regular meeting after the close of the posting period. This time period may be extended by mutual agreement of the Board and the Union. E. Bargaining unit employees accepting bidding into new classifications shall have five (5) working days to return their previous position without loss of seniority in that position. SECTION 15.7 This bid procedure applies only to classified positions within the bargaining unit. BID PROCEDURE. 19.1 When a vacancy occurs in the District in any bargaining unit classification, and the Board decides to fill the positiona classification or a location assignment, it shall be posted on the staff bulletin board in all school building offices or Board-owned facilities a conspicuous place for a period of ten (10) working days. Working day is defined under this Article as a week day, unless the day is scheduled as a holiday (day off on the school calendar). Any active or laid off employee may request the vacant position in writing. If the Board of Education determines to fill any vacancy, such vacancy will be filled within thirty (30) working days, except that if a vacancy occurs within 60 working days of the end of the school year, the vacancy will be filled before the beginning of the subsequent school year. In selecting the placement employee, the Board shall apply the following formula: A. The vacant position shall first be offered to the employees within the department or classification of the position who are qualified for the position. B. If an employee within the same department or classification requests the position in writing, the employee with the highest seniority date who is qualified for the position shall be awarded the position. C. The highest seniority date shall be determined by the employee’s last date of hire by the Board of Education. D. If the position is not filled by an employee within the vacant classification or position, any employee may apply for the position and will be given consideration before a new employee is hired. Such consideration shall be based on meeting the existing qualifications for the position and seniority shall determine when two or more qualified employees apply. E. Employees may be awarded second positions within the School District in accordance with the provisions of this Article, provided the employee meets the following criteria: 1. The employee must be able to complete all of the requirements of the primary position as well as the secondary position. 2. The employee will work with the administration in scheduling to assure that the jobs do not conflict. 3. The Board of Education is under no obligation to offer a second position to an employee if the completion of work in the primary job and secondary job would result in the automatic payment of overtime. 4. The employee must be physically capable of performing both jobs. F. Job postings shall be posted in all District locations during the summer months and shall be placed on the district website and email for employees is not normally scheduled to work during the summer months. G. For vacancies occurring during the thirty (30) days before the first day of the school year, the posting requirements herein shall not apply, but the Superintendent will notify the Association President of such vacancy. 19.2 One Day Bid Procedure A. During the summer months, when school is not in session, the Board and the Union may, by mutual agreement, schedule a one day bid session for the classification where the vacancy exists. All employees in the affected classification shall be notified five (5) work daysworking days in advance of a scheduled one day bid session.
