Common use of Bituminous Material Clause in Contracts

Bituminous Material. All adjustments shall be determined by calculating the difference between the base index, which shall be established at the time of the bid closing, and the current index. Any adjustments shall be based on the index available on the 15th day of the month and shall be based on the unrevised indexes. If for some reason the information for the current month has not been updated, the adjustment will be made from the previous month. The percentage of the difference between the indexes shall be applied to Contractor unit price. Any increase or decrease in the contract price(s) shall only apply to orders that are dated after the price adjustment has been processed by the County. Adjustments shall be calculated using form ▇▇▇-▇▇▇-▇▇, (Section 5, Attachment G) Vendor’s Estimate Worksheet Bituminous and Polymer Material. This form can be found by going to the following link; Fuel and Bituminous Average Price Index (▇▇▇▇.▇▇▇), and then select the link associated with “Lump Sum & Design-Build, Asphalt & Bituminous Adjustments on projects let January 2007 forward”. If determined to be in the best interest of the County, this same procedure can be employed by the County to adjust the cost charged by Contractor for bituminous materials. This clause may be used in addition to any other price redetermination clause presented. The undersigned hereby declares that: Middlesex Paving, LLC. has examined and accepts the specifications, terms, and conditions presented in this Solicitation, satisfies all legal requirements to do business with the County, and to furnish BID NAME for which Submittals were advertised to be received no later than 3:00 P.M. Eastern time on the date stated in the solicitation or as noted in an addenda. Furthermore, the undersigned is duly authorized to execute this document and any contracts or other transactions required by award of this Solicitation.
