Borrower Organization and Name. The Borrower is a limited liability company duly organized, existing and in good standing under the laws of the State of Kansas, with full and adequate power to carry on and conduct its business as presently conducted. The Borrower is duly licensed or qualified in all foreign jurisdictions wherein the nature of its activities require such qualification or licensing, except for such jurisdictions where the failure to so qualify would not have a Material Adverse Effect. The Borrower’s Organizational Identification Number is 2▇-▇▇▇▇▇▇▇. The exact legal name of the Borrower is as set forth in the first paragraph of this Agreement, and the Borrower currently does not conduct, nor has it during its existence conducted, business under any other name or trade name, except for United Bio Energy Fuels, LLC.
