Common use of Borrowing Base Confirmation Clause in Contracts

Borrowing Base Confirmation. The Agent shall have received a duly completed and executed certificate regarding the Borrowing Base in the form attached hereto as Exhibit D (a "Borrowing Base Confirmation"), computed as of the date of such Advance and after giving effect thereto and to the purchase by the Borrower of any Receivables to be purchased by it under the Sale and Contribution Agreement on such date;

Borrowing Base Confirmation. The Agent shall have received a duly completed and executed certificate regarding the Borrowing Base in the form attached hereto as Exhibit EXHIBIT D (a "Borrowing Base ConfirmationBORROWING BASE CONFIRMATION"), computed as of the date of such Advance and after giving effect thereto and to the purchase by the Borrower of any Receivables to be purchased by it under the Sale and Contribution Purchase Agreement on such date;
