Breach of Terms. If the hirer or his/her invitees are found to be in serious breach of the terms of this agreement DCCA reserves the right to terminate the use of the room hired forthwith.

If the Borrower fails to make payment of any instalment on due date and the Lender decides to enforce the acceleration clause, he shall first give written notice to the Borrower calling upon him or her to make payment within (number) days, failing which the Lender shall be entitled to claim payment of whatever is due in terms of this agreement by way of summons.

The duration of the temporary exclusion is from one to three months depending on the nature of the violation.
13.3 Cancelling the Agreement In the event of a material breach of contract, Fingrid shall be entitled to terminate the Balancing Market Agreement as laid down in that contract or the Balancing Capacity Agreement as laid down in that contract.

The Owner understands that the labor and materials outlined in the Job Standards and Specifications in the Construction Contract and this Agreement will be provided to the Owner at no cost. 13.2 Verification of control properties of reserves, and the Balancing Service Pro- vider’s reimbursement obligation Fingrid is entitled to verify the control properties of a Reserve Unit. If a significant deficiency is detected during the inspection, a temporary exclusion from the reserve market will be carried out in accordance with section 13.3. A signif- icant deficiency means incorrect activation of the reserve, for example a slower acti- vation speed than required or a shortfall in the amount of activated reserve. Once it has been reliably shown that the deficiency has been corrected, the Reserve Unit can return to the market. This can be demonstrated by a technical report or a new adjustment test, the costs of which are borne by the Balancing Service Provider. If, based on Fingrid's monitoring, a minor deficiency is detected, the Balancing Ser- vice Provider must provide based on Fingrid's request, a report on reserve mainte- ▇▇▇▇▇ deficiencies within 30 days. A slight deficiency means a deficiency which, how- ever, based on the information used in the inspection, has not significantly affected the activation of the reserve in accordance with the requirements. It can be, for ex- ample, an activation that meets the requirements but deviates from the results of the prequalification test, a deficiency in the quality of the measurement data provided by the reserve meter, or another observation that requires further clarification. The Re- serve supplier is responsible for the costs of the investigation. If, based on the inves- tigation, a minor deficiency becomes a significant deficiency, the follow-up measures are the same as in the case of a significant deficiency detected in the initial inspec- tion. If the Balancing Service Provider fails to provide the account requested by Fingrid by the deadline, the Balancing Service Provider shall reimburse the fees based on these terms and conditions for the period of the account in terms of both the Frequency Containment Reserve for Normal Operation and Frequency Containment Reserve for Disturbances.
