Common use of BREACH OR DEFAULT BY TENANT Clause in Contracts

BREACH OR DEFAULT BY TENANT. Any breach by Tenant of any conditions of this Lease, other than payment of the rent pursuant to Section 3.01, may be cured by Landlord for the account of and at the expense of Tenant, and any sums so advanced shall be paid to Landlord 14 days after Landlord provides Tenant of notice thereof. Further, if Tenant shall fail to pay the rent pursuant to Section 3.01 or the Additional Rent within 14 days after being due and receiving a written demand therefor, Landlord shall have the right to recover the rent owed (together with any applicable late fee) and to reenter and take possession of the Premises and cancel and annul the remainder of this Lease. If Tenant defaults in any condition or covenant of the Lease or in performing the same, and fails to correct such default within 14 days of receiving the written notice of Landlord thereof, Landlord may, at its option, terminate this Lease; provided that such default is a default that by its nature is curable within such 14- day period.
