BUILDING CHARACTERISTICS. (a) The height and massing of the building shall be in substantive accordance with the elevation drawings as shown in Schedule B. (b) The architectural style and character-defining details of the building shall be in substantive accordance with the elevation drawings as shown in Schedule B. (c) The other exterior design elements of the building shall be in reasonable accordance with the elevation drawings as shown in Schedule B.
BUILDING CHARACTERISTICS. (a) The height, massing, exterior design (including but not limited to the architectural style, the shape of the roof, and the number, size and placement of windows), building materials, and tone shall be as shown on Schedule D. (b) Front, side, and rear yard setbacks of all structures on the Property shall be no less than those indicated on the Site Plan attached to this Agreement as Schedule B.

(c) There shall be step-backs as shown on the elevation drawings in Schedule C, and they shall be in substantive accordance with the measurements identified on the site plan in Schedule D. (d) A primary entrance for each commercial unit shall be oriented towards King Street, directly connected to the street or public plaza, and comprised of clear glass windows with a minimum of 88% light transmission. (e) The primary entrance to the multi-unit residential portion of the development facing King Street shall be recessed. (f) There shall be a minimum of 50% window coverage on each façade of the ground floor commercial area. (g) The placement and orientation of windows and doors shall be in reasonable accordance with the elevation drawings as shown in Schedule C.

(b) The building shall be no more than six (6) stories from King Street grade. (c) The historic character-defining elements of the existing two-story building must be maintained in accordance with the King Street Architectural Controls of the Land Use By-law, as amended from time to time. (d) The building shall have a distinct top story, including but not limited to colour and separation by an architectural feature. (e) There shall be a minimum 4 foot step-back at the base of the third story, measured from King Street grade, on the King Street and Phoenix Street façades. (f) Unless otherwise required by the National Building Code, the exterior cladding on the King Street and Phoenix Street façades, on stories 3-6 inclusive, shall be traditional wooden clapboards or shingles.
BUILDING CHARACTERISTICS. (a) The height and massing of the building shall not be substantially altered; (b) Any signage will be in keeping with the existing signage and will conform to the land use bylaw, as amended from time to time.

  • Characteristics The Contracts have the following characteristics: (i) all the Contracts are secured by Motorcycles; (ii) no Contract has a remaining maturity of more than 84 months; and (iii) the final scheduled payment on the Contract with the latest maturity is due no later than September 6, 2031. Approximately 74.40% of the Pool Balance as of the Cutoff Date is attributable to loans for purchases of new Motorcycles and approximately 25.60% is attributable to loans for purchases of used Motorcycles. No Contract was originated after the Cutoff Date. No Contract has a Contract Rate less than 0.010%.

  • Individual Characteristics Each Receivable has the following individual characteristics as of the Cut-Off Date: (i) each Receivable is secured by a new or used automobile, minivan or sport utility vehicle; (ii) each Receivable has a Contract Rate of no less than 0.00%; (iii) each Receivable had an original term to maturity of not more than 72 months and not less than 12 months and each Receivable has a remaining term to maturity, as of the Cut-Off Date, of 3 months or more; (iv) each Receivable has an Outstanding Principal Balance as of the Cut-Off Date of greater than or equal to $1,000.00; (v) no Receivable has a scheduled maturity date later than July 31, 2027; Schedule I-1 Schedule I to the Purchase Agreement (vi) no Receivable was more than 30 days past due as of the Cut-Off Date; (vii) as of the Cut-off Date, no Receivable was noted in the records of VCI or the Servicer as being the subject of any pending bankruptcy or insolvency proceeding; (viii) no Receivable is subject to a force-placed Insurance Policy on the related Financed Vehicle; and (ix) each Receivable is a Simple Interest Receivable.

  • Mortgage Loan Characteristics The characteristics of the related Mortgage Loan Package are as set forth on the description of the pool characteristics for the applicable Mortgage Loan Package delivered pursuant to Section 11 on the related Closing Date in the form attached as Exhibit B to each related Assignment and Conveyance Agreement;

  • Configuration The configuration for the Purchase Right Aircraft will be the Detail Specification for Model 767-3S2F aircraft at the revision level in effect at the time of the Supplemental Agreement. Such Detail Specification will be revised to include (i) changes required to obtain required regulatory certificates and (ii) other changes as mutually agreed upon by Boeing and Customer.

  • DESCRIPTION OF THE PREMISES Prior to, or during the first month of the effective use (transfer of keys) of the rented property and whenever important alterations have been made to the rented property during the rental period, both parties are obliged to draw up a detailed and contradictory description of the property at their joint expense. If one of the parties so requests, the parties will draw up a detailed and contradictory description of the premises at their joint expense at the end of the rental period. In the absence of an initial description of the premises, the tenant is deemed to have received the property in the condition in which it is in at the time they leave, except if the necessary proof to the contrary is provided. The same applies if no final description of the premises has been drawn up by the end date of the contract. After signature by the contracting parties, the description of the premises will be appended to the present agreement. The lessor has the right to make the reimbursement or release of the deposit dependent on the drawing up of the final description of the premises in the presence of the tenant or their representative, at a mutually agreed time. The lessor will make every effort to be present at this description of the premises at a reasonable time.
