Business with Borrower. The Agent may accept deposits from, lend money to and generally engage in any kind of banking or other business with the Borrower.
Business with Borrower. Notwithstanding the agency herein constituted, Bank One, in its individual capacity, may, without liability to account, make loans to, accept deposits from and generally engage in any kind of banking or trust business with Borrower. The Lenders expressly acknowledge and agree that such activities shall not constitute (and shall not be construed to constitute) a conflict of interest with the Agent's performance of its duties hereunder.
