Calculation of Annual Leave Pay. Annual leave pay (including any proportionate payments) shall be calculated as follows: (a) Subject to the provisions of paragraph 7.1.7(b), in no case shall the payment by an employer to an employee be less than the sum of the following amounts: (i) The employee’s ordinary wage rate as prescribed by clause 5.2 for the period of the annual leave (excluding weekend penalty rates) and late work penalty and time as per 6.5.2 and 6.5.3 (ii) A further amount calculated at the rate of 17.5% of the amount referred to in clause 7.1.7(a)(i). (b) Clause 7.1.7 (a) shall not apply to: (i) any period or periods of annual leave exceeding 152 hours; or (ii) employers (and their employees) who are already paying (or receiving) an annual leave bonus loading or other annual leave payment which is not less favourable to employees.
