Common use of CALL-OFF CONTRACT PERFORMANCE Clause in Contracts

CALL-OFF CONTRACT PERFORMANCE. 12.1. The Training Provider shall perform all Call-Off Contracts entered into with CITB-ConstructionSkills in accordance with:- 12.1.1. the requirements of this Framework Agreement; and 12.1.2. the Funding Requirements and all Guidance; and 12.1.3. the terms and conditions of the respective Call-Off Contracts. 12.2. CITB-ConstructionSkills may, during and/or at the end of any Call-Off Contract, request feedback from Learners in the form of a feedback form or questionnaire (‘Feedback’). If, in the reasonable opinion of CITB-ConstructionSkills, the Feedback or any other information received by CITB-ConstructionSkills indicates shortcomings in the standard of teaching or conduct of Trainers provided by the Training Provider, CITB-ConstructionSkills shall be entitled to provide to the Training Provider an action plan detailing the areas in which the Training Provider’s performance fell below the standard required by this Framework Agreement or any Call-Off Contract and setting out the remedial actions required together with a timescale for implementation of such remedial actions. The Training Provider undertakes to implement any remedial actions set out in the action plan within the timescales set out in the action plan. 12.3. Where an action plan has been issued pursuant to Clause 12.2, CITB- ConstructionSkills shall request further Feedback from Learners or Employers during or following completion of the next Call-Off Contract undertaken by the Training Provider. If such Feedback indicates, in the reasonable opinion of CITB-ConstructionSkills, that no material improvement in the performance of the Services has occurred, CITB-ConstructionSkills reserves the right to terminate this Framework Agreement. 12.4. The Training Provider shall notify the CITB-ConstructionSkills Contract and Standards Team by email at the following address (▇▇▇▇▇▇▇▇▇.▇▇▇▇▇▇▇▇▇@▇▇▇▇▇▇▇.▇▇▇) immediately where any Relevant Awarding Body imposes sanctions on the Training Provider that will need to be ratified by a senior quality advisor or the quality assurance manager in accordance with the CSA Approved Centre Guide and shall provide CITB-ConstructionSkills with an action plan for remedying the breach identified. CITB-ConstructionSkills reserves the right to withdraw Learners from the Training Provider or terminate this Framework Agreement in accordance with clause 25.1.1 where such sanctions are imposed 12.5. In the event of, and only to the extent of, any conflict between the terms and conditions of this Framework Agreement and the terms and conditions of a Call- Off Contract, the terms and conditions of this Framework Agreement shall prevail.
