Call Requirements. The Contractor shall ensure that prepaid and collect calling is available for all locations within the North American Dialing Plan. In addition, the Contractor shall provide a list of all countries (outside of the United States) that can be reached via the ITS operating in a “collect call only” mode. At no time shall an inmate be automatically connected to a “live” operator. The only exception to this requirement is that international collect calls through a live operator will be allowed when the country being called accepts collect calls. Call acceptance by the called party shall be accomplished through caller confirmation (“positive acceptance”). Collect or prepaid calls shall not be connected nor shall billing commence until the called party indicates acceptance of the call. The Contractor shall ensure that non-prepaid calls (collect calls) are billed to the Billing Number Address as preferred by the customer (inmate family or friend) either directly the Contractor or through the LEC. The Contractor shall be responsible for billing called parties who receive non- prepaid collect calls and for the collection of payments for these calls. In no event shall the Department be responsible for costs or fees related to ITS calls. The Contractor shall provide a toll free number which will be clearly shown on the called party’s ▇▇▇▇ for assistance in billing matters. The Contractor shall ensure Caller ID is not available for any call placed through the ITS, and that the called party has no means of identifying the number from which a call is placed. The Contractor shall not charge for calls that result in Special Information Tones (SIT), “ring/no answer”, or “busy” conditions. The Contractor shall provide local exchange service for collect or prepaid only calling use at each Department institution. The local calling area shall be equivalent to the local calling public pay telephone area at each Department institution. The Contractor shall ensure that the ITS is capable of identifying a dialed number as local, based on the pay telephone calling area, and of correctly rating and routing the call.
Call Requirements. MGI shall be obligated to use its Best Efforts to deliver detailing and promotion of the Product during seventy-five percent (75%) of the Visits actually made by the MGI Sales Force to MGI Physicians in the Territory. In the event MGI fails to perform its obligations under this SECTION 4.5 such that Connetics has Good Cause to terminate this Agreement, Connetics' remedy shall be limited to the provisions set forth in SECTION 11.4(b).

All 15 nurses will be required to take call. CPT nurses may utilize call shifts to meet their 16 minimum requirements. Weekend Call shall be rotated on a fair and equitable basis, 17 taking into consideration skill mix. 18 B. Nurses not scheduled on-call may not be mandated to answer their phones when 19 contacted. Nurses are required to answer their phones from the time they are scheduled 20 to start call.

The following number of employees in each of the following classifications may be used for call response during each on-call period: • 1 OR Nurses • 1 Surgical Technician • 1 Pre-Op/PACU Nurses Nothing set forth in this Article shall prevent the use of employees otherwise assigned to work to be used to reduce the call requirements subject to patient needs and safety. 2. The “on-call hours” for personnel designated in Article 23.2.A.1 shall be (1) Monday through Friday from 7:00 PM until 11:00 PM; (ii) Saturday from 8:00 AM until 6:00 PM and (iii) Sunday or holidays designated under Article 21 of this Agreement (which shall include the actual day of the holiday and the day the holiday is observed) from 8:00 AM to 4:00. Any employee in any department who is working on call and who works beyond the employee’s scheduled on-call hours on a Saturday, Sunday or holiday shall be paid double time for all hours worked during that on-call shift, plus any allowed Sleep Time under Article 23.2.G. There shall be no pyramiding of overtime and additional premium compensation under this Article. 3. On-Call a. Weekend SPD/CPD Surgical Coordinators. Employees hired for work as Weekend SPD/CPD Surgical Coordinators shall not be subject to the call provisions in this Article but shall be required to work on Saturday and/or Sunday as needed. In such circumstances, a Weekend SPD/CPD Surgical Coordinator shall be called in by the Hospital on an alternating weekend basis if there is more than one designated Weekend SPD/CPD Surgical Coordinator. Further, the Weekend SPD/CPD Surgical Coordinator required to work on alternating weekend days shall not be eligible for on-call pay for those days but shall be paid at the employee’s overtime rate. b. SPD/CPD Surgical Coordinator Call. Regular SPD/CPD staff members shall be required to be scheduled for call on Saturdays, Sundays and holidays at times designated in Article 23,2.A.2 of this Agreement on an alternating basis if Weekend SPD/CPD Surgical Coordinators are not available for any reason. Any regular SPD/CPD staff member called in to work on a Saturday, Sunday or holiday shall be paid a minimum of 4 hours at time-and-a-half rate. Further, any regular SPD/CPD staff member who is scheduled for call for Saturday, Sunday or holiday hours shall also be paid on-call pay for those days if not called in to work on the same basis as otherwise set forth in this Article.
