Common use of Cancellation and Curtailment Clause in Contracts

Cancellation and Curtailment. The Assistance Company will pay, up to the sum insured as specified in the Schedule of Benefits per trip for all Beneficiaries, for all non-recoverable deposits, advance payments and other charges paid or due to be paid by or on behalf of the Beneficiary for travel and accommodation and also for reasonable and necessary extra travel or accommodation expenses for return to the Beneficiary’s Country of Residence in the event of a covered trip being reasonable and necessarily cancelled or curtailed because of: • The death, body injury, Illness, or complication of pregnancy of: o the Beneficiary, or any person with whom he/she is travelling or has arranged to travel with, or any person with whom he/she has arranged to reside temporarily, o a Beneficiary’s Close relative, o the Beneficiary’s business associate. As an exception to the General Exclusions, the Beneficiary is covered under the same terms if before travelling: o the Beneficiary falls ill at home with an infectious disease and cannot travel. o the Beneficiary or a Close Relative has to self-isolate at home because of an infectious disease and cannot travel Abroad (subject to medical certification); o the Beneficiary has been denied boarding at airport due to detected symptoms of an infectious disease. o The destination the Beneficiary is travelling is subject to travel restrictions by Ministry of foreign affairs, or denial of entry by the local authorities, or is required to quarantine upon arrival (or upon return in the Country of Residence). As an exception to the General Exclusions, the Beneficiary is covered under the same terms if during the trip, travel restrictions are imposed asking to the Beneficiary to return at home due to a pandemic illness. • jury service attendance or being called as a witness at a Court of Law of the Beneficiary or any person with whom he/she is travelling or has arranged to travel with. • redundancy which qualifies for payment under the current redundancy payment legislation in the Country of Residence and at the time of booking the trip there was no reason to believe anyone would be made redundant of the Beneficiary or any person with whom he/she is travelling or has arranged to travel with. • the withdrawal of leave for members of the Armed Forces, Police, Fire, Nursing or Ambulance Services or employees of a Government Department, provided that such cancellation or curtailment could not reasonably have been expected at the time of receiving these benefits or booking the trip (whichever is the later). • the Police requesting the Beneficiary, within seven (7) days of his/her departure date, to remain at or subsequently return to his/her home due to serious damage to his/her home caused by fire, aircraft, explosion, storm, subsidence, malicious person or theft.

Cancellation and Curtailment. The Assistance Company will payIf the Insured Person abandons an Insured Journey on written medical advice or returns to their Country of Domicile on written medical advice, up to the sum insured or is ill, injured or admitted into a local Hospital or a local clinic as specified in the Schedule of Benefits per trip for all Beneficiariesan in-patient, for all nonor a Hospital or a clinic whilst on an Insured Journey as an in-recoverable deposits, advance payments patient and other charges paid or due is likely to be paid by in Hospital for more than 12 (twelve) Hours, the Insured Person or any person on behalf of the Beneficiary Insured Person must contact HealthWatch within 24 (twenty-four) hours in order that HealthWatch can confirm the Conditions of cover. If this is not done, it could mean that We may not provide any cover, or the amount of benefit paid for travel and accommodation and Cancellation or Curtailment will be reduced or denied. We or HealthWatch reserve the right to relocate the Insured Person from one Hospital to another. We also for reasonable and necessary extra travel or accommodation expenses for return reserve the right to limit payment to what the HealthWatch appointed Qualified Medical Practitioner deems to be reasonable. To pay up to the Beneficiary’s Country of Residence amount stated in the event Schedules of a covered trip being reasonable Compensation in all for the Insured Person in respect of reimbursement for the benefit of the Insured Person only, of deposits paid and forfeited and further non-returnable payments due under the terms of the travel booking conditions if the Insured Journey is necessarily and unavoidably cancelled or which means that the Insured Person does not travel on their Insured Journey and/or if the Insured Journey is necessarily and unavoidably curtailed because of: • due to: 1) The death, body injuryserious Bodily Injury or serious illness of: (a) The Insured Person(s), Illness, or complication of pregnancy of: o the Beneficiary, or any or (b) The person with whom he/she the Insured Person is travelling or has had arranged to travel withtravel, such person having the same Country of Domicile as the Insured Person, or (c) The spouse, common-law/civil partner, parent, step-parent, parent-in-law, grandparent, child, step-child, grandchild, brother, sister, son, daughter, fiancé(e) or any Close Business Colleague of the Insured Person, such person having the same Country of Domicile as the Insured Person. 2) Jury service, military service, attendance under a subpoena as a witness in a court of law or the compulsory quarantine restriction of the Insured Person or of the person with whom he/she has arranged to reside temporarily, o a Beneficiary’s Close relative, o the Beneficiary’s business associate. (B) Notwithstanding the above the amount payable is further limited in respect of Cancellation claims to the scale of cancellation charges as defined in the travel booking the trip there was no reason to believe anyone would be made redundant conditions of the Beneficiary provider of transport or any person accommodation. (C) In respect of Curtailment claims the amount is limited as in (A) above but is further limited to the proportionate amount of the total pre-paid cost for each day of the Insured Journey foregone. (D) In respect of Cancellation claims the Insured Person has a duty to first seek reimbursement from the Common Carrier and /or tour operator with whom he/she is travelling or has arranged to travel with. • they have booked the withdrawal of leave for members of the Armed Forces, Police, Fire, Nursing or Ambulance Services or employees of a Government Department, provided that such cancellation or curtailment could not reasonably have been expected at the time of receiving these benefits or booking the trip (whichever is the later). • the Police requesting the Beneficiary, within seven (7) days of his/her departure date, to remain at or subsequently return to his/her home due to serious damage to his/her home caused by fire, aircraft, explosion, storm, subsidence, malicious person or thefttrip.
