Common use of Cancellation by Customer Clause in Contracts

Cancellation by Customer. If the Customer fails to pay the Fee in full by the due date as detailed in clause 3.1, or the Customer gives the Seller notice in writing of its intention to cancel the Package then, without prejudice to any other right or remedy available to the Seller, the Seller shall be entitled to cancel the Contract and suspend provision of the Package and any further services to the Customer and; (a) Where cancellation takes place more than 20 weeks from the Event Date the Seller shall refund to the Customer the Fee paid less the booking fee. (b) Where cancellation takes place between 20 weeks and 6 weeks prior to the Event Date, the Customer shall be liable to the Seller for 25% of the Fee and shall only be entitled to a refund of 75% of the Fee paid, less the booking fee. (c) Where cancellation takes place within 6 weeks or less prior to the Event Date, the Customer shall be liable to the Seller for 50% of the Fee and shall only be entitled to a refund of 50% of the Fee paid, less the booking fee. (d) Where cancellation takes place within 1 week or less prior to the Event Date the Customer shall be liable to the Seller for 100% of the Fee and shall be entitled to no refund.
