Common use of CANCELLATION OF PERFORMANCE Clause in Contracts

CANCELLATION OF PERFORMANCE. a. In the event VENUE cancels the PERFORMANCE for any reason less than five (5) weeks before the date of such PERFORMANCE, VENUE will pay CHORUS as liquidated damages, one half (1/2) of the COMPENSATION FEE agreed to be paid for such PERFORMANCE as stated in Paragraph IV. In the event VENUE cancels the PERFORMANCE for any reason less than two (2) weeks before the date of such PERFORMANCE, VENUE will pay CHORUS as liquidated damages, the full COMPENSATION FEE agreed to be paid for such PERFORMANCE as stated in Paragraph IV, unless CHORUS subsequently agrees in writing to waive all or any part of that payment. b. CHORUS shall have the right to cancel the PERFORMANCE for any reason up to five (5) weeks prior to the date of such PERFORMANCE. In the case of such cancellation, neither VENUE or CHORUS shall be paid the COMPENSATION FEE agreed to be paid for such PERFORMANCE as stated in Paragraph IV.
