Capacity Allocations. If the quantity of Shipper Gas and all other Gas available for delivery into a Receipt Point, Plant inlet or any other point on the Olympia Gathering System exceeds the capacity of the Olympia Gathering System at any such point, then, except with respect to Plant capacity constraints resulting from the violation by violation of Plant Inlet Specifications (which Plant capacity shall be allocated in accordance with the process established in Section 3.3 of this Agreement (and not Section 3.3 of these General Terms and Conditions)), Gatherer shall interrupt or curtail receipts of Shipper Gas in accordance with the following. (a) First, Gatherer shall curtail all Interruptible Gas prior to curtailing Preferential Capacity Gas. (b) Second, if additional curtailments are required beyond Section 3.3(a) above, Gatherer shall curtail Preferential Capacity Gas In the event Gatherer curtails some, but not all Preferential Capacity Gas on a particular Day, Gatherer shall allocate the capacity of the Olympia Gathering System available to such Preferential Capacity Shippers on a pro rata basis based upon Shipper’s and the other Preferential Capacity Shipper’s average of the confirmed nominations for the previous 14 Day period of Preferential Capacity Gas prior to the event causing the curtailment.
