Common use of Capacity Interconnection Rights Clause in Contracts

Capacity Interconnection Rights. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 584.2639.8 MW. The amount of Capacity Interconnection Rights specified above (584.2639.8 MW) includes 551553.2 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service Agreement, and 33.0 MW86.6MW of Capacity Interconnection Rights granted as a result of suchthis Interconnection Request. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have the additional 33 MW of Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 639.8 MW commencing June 1, 2015. During the time period from2021. From the effective date of this ISA until May 31, 20152021 (the “interim time period”), in addition to the 553.2 MW of Capacity Interconnection Rights the Interconnection Customer had at the same Point of Interconnection prior to its Interconnection Request associated with this ISA, the Interconnection Customer also may be awarded these additional 33 MW of interim Capacity Interconnection Rights in the amount not to exceed 86.6 MW. Accordingly, during the interim time period, the Interconnection Customer shall have 553.2 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 86.6 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and the results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 20152021.

Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have the additional 33 7 MW of Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 639.8 MW commencing June 1, 20152017. During the time period from2021. From from the effective date of this ISA until May 31, 20152021 2017 (the “interim interim” time period”), in addition to the 553.2 MW of Capacity Interconnection Rights the Interconnection Customer had at the same Point of Interconnection prior to its Interconnection Request associated with this ISA, the Interconnection Customer also may be awarded these additional 33 MW of interim Capacity Interconnection Rights in the amount not to exceed 86.6 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and the results of an interim deliverability study. Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have the additional 33 40 MW of Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 639.8 MW commencing June 1, 2015associated with Queue Position # AB1-106. During the time period from2021. From from the effective date of this ISA until to May 31, 20152021 2020 (the “interim time period”), in addition to the 553.2 900 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point of Interconnection prior to its Interconnection Request associated with this ISAthe Queue Position #T174 Interconnection Request, the Interconnection Customer also may be awarded these additional 33 MW of interim Capacity Interconnection Rights in the an amount not to exceed 86.6 40 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and the results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 201520212020.

The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 2020. Accordingly, during the interim time period, the Interconnection Customer shall have 553.2 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights associated with PJM Queue #AC2-066 in an the amount not to exceed 86.6 28.5 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and the results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the first interim time period shall terminate May 31, 2020. Interconnection Customer shall have a total of 76 MW of Capacity Interconnection Rights associated with Queue #AB1-014 and #AC2-066, commencing on June 1, 2020. During the time period from June 1, 2020, to May 31, 2022 (the “second interim time period”), in addition to the 76 MW of Capacity Interconnection Rights the Interconnection Customer has at the same Point of Interconnection associated with PJM Queue #AB1-014 and #AC2-066, the Interconnection Customer also may be awarded interim Capacity Interconnection Rights associated with PJM Queue #AE1-120 in an amount not to exceed 44 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the second interim time period shall terminate on May 31, 201520212022. Interconnection Customer shall have a total of 120 MW of Capacity Interconnection Rights associated with Queue #AB1-014, #AC2-066, and #AE1- 120, commencing on June 1, 2022.

Pursuant to and subject to the applicable terms of the Tariff, the Interconnection Customer shall have the additional 33 MW of Capacity Interconnection Rights at the Point(s) of Interconnection specified in this Interconnection Service Agreement in the amount of 639.8 19.557 MW commencing June 1, 20152018, coincident with completion of PJM RTEP baseline upgrade b2288. . The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and the results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 201520212022. Accordingly, during the interim time period, the Interconnection Customer shall have 553.2 672 MW of previously awarded Capacity Interconnection Rights and may be awarded interim Capacity Interconnection Rights in an amount not to exceed 86.6 20 MW. The availability and amount of such interim Capacity Interconnection Rights shall be dependent upon completion and the results of an interim deliverability study. Any interim Capacity Interconnection Rights awarded during the interim time period shall terminate on May 31, 201520212020. The amount of Capacity Interconnection Rights specified above (692 MW) includes 672 MW of Capacity Interconnection Rights that the Interconnection Customer had at the same Point(s) of Interconnection prior to its Interconnection Request associated with this Interconnection Service Agreement, and 20 MW of Capacity Interconnection Rights granted as a result of such Interconnection Request.

Capacity Interconnection Rights.
