Certain Personal Property. SCHEDULE 3.9 lists each item of tangible personal property that was reflected in the audited Financial Statements and that has a fair market value in excess of $5,000. Except for those items subject to the Personal Property Leases and certain computer hardware and software owned by the Companies' employees or consultants with an aggregate value of less than $5,000, no Person other than the Companies own any vehicles, material equipment or other material tangible assets located on the Real Property that have been used in the Business or that are necessary for the operation of the Business.
