CERTIFICATE OF DESIGNER/BUILDER. Designer/Builder certifies that the Designer/Builder is properly certified and licensed under the laws and regulations of the State of California to perform the Work that it has herein agreed to perform. The Designer/Builder has been selected to perform the Work herein because of the skills and expertise of key individuals. The Designer/Builder shall not change any of the key personnel without prior written notice to District, unless said personnel cease to be employed by Designer/Builder. If any designated lead or key person fails to perform to the reasonable satisfaction of the District, then upon written notice the Designer/Builder shall have ten (10) days to remove that person from the Project and replace that person with one reasonably acceptable to the District. Designer/Builder shall comply with Education Code section 17302(a) and agrees that any plans and/or specifications included in the Work shall be prepared under the supervision of licensed personnel, and that licensed personnel shall be in “responsible charge” of persons who observe the construction.

The successor Owner Trustee will promptly deliver a file-stamped copy of the certificate of amendment to the Administrator.

  • Release of Design Plan The Engineer (1) will not release any roadway design plan created or collected under this contract except to its subproviders as necessary to complete the contract; (2) shall include a provision in all subcontracts which acknowledges the State’s ownership of the design plan and prohibits its use for any use other than the project identified in this contract; and (3) is responsible for any improper use of the design plan by its employees, officers, or subproviders, including costs, damages, or other liability resulting from improper use. Neither the Engineer nor any subprovider may charge a fee for the portion of the design plan created by the State.

  • Filing of Certificate of Designation The Certificate of Designation shall have been filed with the Secretary of State of the State of Delaware.
