CERTIFICATION AND AUTHORIZATION. Upon successful completion of initial training, LEA personnel shall be deemed “certified” under this MOA. ICE will certify in writing the names of those LEA personnel who successfully complete training and pass all required test(s). Upon receipt of the certification, the ICE Field Office Director (FOD) will provide the participating LEA personnel a signed authorization letter allowing the named LEA personnel to perform specified functions of an immigration officer. Such credentials provided by ICE shall remain the property of ICE and shall be returned to ICE upon termination of this agreement, when a participating LEA employee ceases his/her participation, or when deemed necessary by the FOD. Authorization of participating LEA personnel to act pursuant to this MOA may be withdrawn at any time and for any reason by ICE and must be memorialized in a written notice of withdrawal identifying an effective date of withdrawal and the personnel to whom the withdrawal pertains. Such withdrawal may be effectuated immediately upon notice to the LEA. The LEA and the FOD will be responsible for notification of the appropriate personnel in their respective agencies. The termination of this MOA shall constitute immediate revocation of all immigration enforcement authorizations delegated hereunder. The LEA will make every attempt, where practicable, to provide ICE with a 90 day notice if participating LEA personnel cease their participation in the program, so that appropriate action can be taken in accordance with ICE policies, including inventorying and retrieval of credentials, and training replacement personnel as needed.

I / we agree to notify The Commons in Lincoln immediately of any significant changes in my financial condition should they occur. I am / We are aware that any material misrepresentation or omission shall be deemed “certified” under this MOAcause for involuntary termination of my agreement with The Commons in Lincoln. ICE I hereby further authorize Benchmark Senior Living LLC to conduct, on its own or with one or more credit reporting agencies (CRAs), an inquiry concerning my credit status and history, and state sex offender registries, as it deems necessary to process my application for residency. I understand that procurement of such reports may provide Benchmark with information as to my background, mode of living, character and personal reputation and release Benchmark Senior Living LLC and any affiliated organizations from any liability and responsibility for doing so. I understand that if Benchmark takes any adverse action based on the credit report, including denying my application or requiring me to provide a guarantor, Benchmark will certify in writing the names of those LEA personnel who successfully complete training and pass all required test(s). Upon receipt provide me with an adverse action notice which includes contact information of the certificationCRA that provided the credit report. A written summary of my rights under the Federal Fair Credit Reporting Act, as amended, is attached to this authorization form. Benchmark will review a report of the ICE Field Office Director (FOD) state sex offender registries with respect to all applicants for residency. Benchmark will not conduct such checks of existing residents, nor will it conduct general criminal background checks due to the inaccessibility of such data in some states. Such credentials provided by ICE shall remain the property of ICE and shall be returned to ICE upon termination of this agreement, when a participating LEA employee ceases his/her participation, or when deemed necessary by the FOD. Authorization of participating LEA LCSO personnel to act pursuant to this MOA may be withdrawn at any time and for any reason by ICE and must be memorialized in a written notice of withdrawal identifying an effective date of withdrawal and the personnel to whom the withdrawal pertains. Such withdrawal may be effectuated immediately upon notice to the LEALafayette County Sheriff's Office. The LEA LCSO and the FOD FOO in The Miami Field Office will be responsible for notification of the appropriate personnel in their respective agencies. The termination of this MOA shall constitute immediate revocation of all immigration enforcement authorizations delegated hereunder. The LEA Lafayette County Sheriff's Office will make every attempt, attemp where practicable, to provide ICE with a 90 day notice if participating LEA LCSO personnel cease their participation in the program, so that appropriate action can be taken in accordance with ICE policies, including inventorying and retrieval of credentials, and training replacement personnel as needed.

CERTIFICATION AND AUTHORIZATION. Upon successful completion of initial IADP training, LEA JCSO personnel shall be deemed “certified” under this MOA. On a yearly basis, ICE will certify in writing the names of those LEA JCSO personnel who successfully complete training and pass all required test(s). Upon receipt of the certification, the ICE Field Office Director (FOD) in Houston Field Office will provide the participating LEA JCSO personnel a signed authorization letter allowing the named LEA JCSO personnel to perform specified functions of an immigration officerofficer for an initial period of one year from the date of the authorization. ICE will also provide a copy of the authorization letter to the LEA. ICE will also execute ICE Form 70-006, Designated Immigration OfficerJCSO. Only those certified LEA JCSO personnel who receive authorization letters and ICE Form 70-006 issued by ICE and whose immigration enforcement efforts are overseen by an ICE supervisor may conduct immigration officer functions described in this MOA. Along with the authorization letter and ICE Form 70-006letter, ICE will issue the certified LEA JCSO personnel official immigration officer credentials. Upon receipt of the credentials, JCSO personnel will provide ICE a signed receipt of the credentials on the ICE Record of Receipt – Property Issued to Employee (Form G-570).
