CERTIFICATION AND AUTHORIZATION. Upon successful completion of initial training, LEA personnel shall be deemed “certified” under this MOA. ICE will certify in writing the names of those LEA personnel who successfully complete training and pass all required test(s). Upon receipt of the certification, the ICE Field Office Director (FOD) will provide the participating LEA personnel a signed authorization letter allowing the named LEA personnel to perform specified functions of an immigration officer. Authorization of participating LEA personnel to act pursuant to this MOA may be withdrawn at any time and for any reason by ICE and must be memorialized in a written notice of withdrawal identifying an effective date of withdrawal and the personnel to whom the withdrawal pertains. Such withdrawal may be effectuated immediately upon notice to the LEA. The LEA and the FOD will be responsible for notification of the appropriate personnel in their respective agencies. The termination of this MOA shall constitute immediate revocation of all immigration enforcement authorizations delegated hereunder. The LEA will make every attempt, where practicable, to provide ICE with a 90 day notice if participating LEA personnel cease their participation in the program, so that appropriate action can be taken in accordance with ICE policies, including inventorying and retrieval of credentials, and training replacement personnel as needed.

ICE will also provide a copy of the authorization letter to the LEA. ICE will also execute ICE Form 70-006, Designated Immigration OfficerLCSO. Only those certified LEA LCSO personnel who receive authorization letters and ICE Form 70-006 issued by ICE and whose immigration enforcement efforts are overseen by an ICE supervisor may conduct immigration officer functions described in this MOA. Along with the authorization letter and ICE Form 70-006letter, ICE will issue the certified LEA LCSO personnel official immigration officer credentials. Upon receipt of the credentials, LCSO personnel will provide ICE a signed receipt of the credentials on the ICE Record of Receipt – Property Issued to Employee (Form G-570). Participating LEA LCSO personnel shall carry their ICE-issued credentials while performing immigration officer functions under this MOA. Such credentials provided by ICE shall remain the property of ICE and shall be returned to ICE upon termination of this agreement, when a participating LEA LCSO employee ceases his/her participation, or when deemed necessary by the FODICE FOD in Salt Lake City, Utah. Authorization of participating LEA LCSO personnel to act pursuant to this MOA may be withdrawn at any time and for any reason by ICE and must be memorialized in a written notice of withdrawal identifying an effective date of withdrawal and the personnel to whom the withdrawal pertains. Such withdrawal may be effectuated immediately upon notice to the LEALCSO. The LEA LCSO and the ICE FOD in Salt Lake City, Utah will be responsible for notification of the appropriate personnel in their respective agencies. The termination of this MOA shall constitute immediate revocation of all immigration enforcement authorizations delegated hereunder. The LEA LCSO will make every attempt, where practicable, to provide notify ICE with a 90 day notice if within 48 hours of when participating LEA LCSO personnel cease their participation in the 287(g) program, so that appropriate action can be taken in accordance with ICE policies, including inventorying and retrieval of credentials, credentials and training replacement personnel as neededtermination of user account access to the appropriate DHS and ICE databases/systems and associated applications.

Upon receipt of the Training Division certification, the ICE Field Office Director (FOD) INS will provide to the participating LEA personnel state and local officers a signed document setting forth the authorization letter allowing the named LEA personnel to perform for an initial period of one year from the date of the authorization, specified functions of an immigration officerimmigration-officer functions. ICE The INS will also provide a copy of the authorization letter to the LEAFDLE and the employing agency of the officer receiving the authorization. ICE Every 3 months, the officer's performance will also execute ICE Form 70-006, Designated Immigration Officer. Only those certified LEA personnel who receive authorization letters be evaluated by the District Director/designee and ICE Form 70-006 issued by ICE and whose immigration enforcement efforts are overseen by ICE may conduct immigration the FDLE Commissioner or designee to ensure that the officer functions described in has conformed to the requirements of this MOA. Along with the authorization letter and ICE Form 70-006, ICE will issue the certified LEA personnel official immigration officer credentialsMOU. Participating LEA personnel shall carry their ICE-issued credentials while performing immigration officer functions under this MOAstate and local officers will provide an opportunity for subjects with limited English language proficiency to request an interpreter. Such credentials Qualified foreign language interpreters will be provided by ICE shall remain the property of ICE and shall be returned to ICE upon termination of this agreement, when a participating LEA employee ceases his/her participation, or when deemed necessary by the FODarresting agency as needed. Authorization of a participating LEA personnel state or local officer to act pursuant to this MOA MOU may be withdrawn revoked at any time and for any reason by ICE and must be memorialized in a written notice the INS, FDLE, or the employing entity of withdrawal identifying an effective date the officer. Such revocation will require immediate notification of withdrawal the INS, FDLE, and/or, the employing entity by the revoking party. The FDLE Commissioner and the personnel to whom the withdrawal pertains. Such withdrawal may be effectuated immediately upon notice to the LEA. The LEA and the FOD INS District Director/Miami will be responsible for notification of the appropriate personnel in their respective agencies. If a participating state or local officer becomes the subject of a complaint of any sort that may result in that officer receiving employer discipline or becoming the subject of a criminal investigation, the employing entity shall, to the extent allowed by state law, immediately notify the FDLE and INS of the complaint. The resolution of the complaint shall be promptly reported to the INS and FDLE. The termination of this MOA MOU shall constitute immediate revocation of all immigration enforcement INS authorizations delegated hereunder. The LEA will make every attempt, where practicable, to provide ICE with a 90 day notice if participating LEA personnel cease their participation in the program, so that appropriate action can be taken in accordance with ICE policies, including inventorying and retrieval of credentials, and training replacement personnel as neededconveyed herein.

I / we agree to notify The Commons in Lincoln immediately of any significant changes in my financial condition should they occur. I am / We are aware that any material misrepresentation or omission shall be deemed “certified” under this MOAcause for involuntary termination of my agreement with The Commons in Lincoln. ICE I hereby further authorize Benchmark Senior Living LLC to conduct, on its own or with one or more credit reporting agencies (CRAs), an inquiry concerning my credit status and history, and state sex offender registries, as it deems necessary to process my application for residency. I understand that procurement of such reports may provide Benchmark with information as to my background, mode of living, character and personal reputation and release Benchmark Senior Living LLC and any affiliated organizations from any liability and responsibility for doing so. I understand that if Benchmark takes any adverse action based on the credit report, including denying my application or requiring me to provide a guarantor, Benchmark will certify in writing the names of those LEA personnel who successfully complete training and pass all required test(s). Upon receipt provide me with an adverse action notice which includes contact information of the certificationCRA that provided the credit report. A written summary of my rights under the Federal Fair Credit Reporting Act, as amended, is attached to this authorization form. Benchmark will review a report of the ICE Field Office Director (FOD) state sex offender registries with respect to all applicants for residency. Benchmark will not conduct such checks of existing residents, nor will it conduct general criminal background checks due to the inaccessibility of such data in some states. Further, not all states provide the participating LEA personnel on-line sex offender registries and, as a signed authorization letter allowing the named LEA personnel to perform specified functions result, our search may not provide complete information. Performance of an immigration officersuch background checks is not intended as a guaranty of resident safety. Participating LEA JCSO personnel shall carry their ICE-issued credentials while performing immigration officer functions under this MOA. Such credentials provided by ICE shall remain the property of ICE and shall be returned to ICE upon termination of this agreement, when a participating LEA JCSO employee ceases his/her participation, or when deemed necessary by the FODICE FOD in Houston Field Office. Authorization of participating LEA JCSO personnel to act pursuant to this MOA may be withdrawn at any time and for any reason by ICE and must be memorialized in a written notice of withdrawal identifying an effective date of withdrawal and the personnel to whom the withdrawal pertains. Such withdrawal may be effectuated immediately upon notice to the LEAJCSO. The LEA JCSO and the ICE FOD in Houston Field Office will be responsible for notification of the appropriate personnel in their respective agencies. The termination of this MOA shall constitute immediate revocation of all immigration enforcement authorizations delegated hereunder. The LEA JCSO will make every attempt, where practicable, to provide notify ICE with a 90 day notice if within 48 hours of when participating LEA JCSO personnel cease their participation in the 287(g) program, so that appropriate action can be taken in accordance with ICE policies, including inventorying and retrieval of credentials, credentials and training replacement personnel as neededtermination of user account access to the appropriate DHS and ICE databases/systems and associated applications.
