Common use of Certification and Licensure Clause in Contracts

Certification and Licensure. 1. The Employer will provide a listing of classes for which existing Instructors are qualified to teach in accordance with the certification, degree or licensure requirements in effect as of November 1, 2011 and thereafter. Such listing will be updated periodically as new Faculty are hired, as new classes are added, or the certification, degree or licensure requirements change. An Instructor disputing his/her qualifications to teach a particular course may appeal to a mutually agreed upon educational consultant who shall render a binding written decision. However, the parties will be bound by any subsequent decision by the accrediting or licensing bodies to the contrary. The cost of the consultant shall be divided equally by the parties. 2. The Employer will assure that Instructors hired after November 1, 2011 meet the applicable certification, degree or licensure requirements then in effect before they are employed. 3. The Employer shall notify Instructors of any change it requires them to meet in certification, degree or licensure requirements, and shall assist Instructors in complying with such changes. 4. The Employer will reimburse Instructors for any fees and expenses paid by them to acquire or maintain the certification, degree or licensure that is required by AiNYC during their employment at AiNYC. The Employer will attempt to accommodate the scheduling needs of the Instructor undertaking such educational efforts. Such accommodation shall not include paid time off unless the Employer’s requirement cannot be met otherwise.
