Certification of No Asbestos Containing Material or Work. 16.1 Contractor shall insure that Texas Department of State Health Services licensed individuals, consultants or companies are used for any required asbestos work including asbestos inspection, asbestos abatement plans/specifications, asbestos abatement, asbestos project management and third- party asbestos monitoring. 16.2 Contractor shall provide a notarized certification to Owner that all equipment and materials used in fulfillment of its Contract responsibilities are non-Asbestos Containing Building Materials (ACBM). This certification must be provided no later than Contractor’s application for Final Payment. 16.3 The Contractor shall insure compliance with the following acts from all of his subcontractors and assigns: • Asbestos Hazard Emergency Response Act (AHERA—40 CFR 763-99 (7)); • National Emission Standards for Hazardous Air Pollutants (NESHAP—EPA 40 CFR 61, Subpart M—National Emission Standard for Asbestos; • Texas Asbestos Health Protection Rules (TAHPR—Tex. Admin. Code Title 25, Part ▇, ▇▇. ▇▇▇▇, ▇▇▇▇▇▇▇▇ Health Protection
