CHANGE IN CONTRACT ELEMENTS AND OPTIONAL SERVICES. 38 CHANGE IN THE DELIVERABLES 38.1 Introducing a Change 38.1.1 Subject to the provisions set out herein, HPC shall have the right, from time to time during the performance of the Contract, to propose and require, that the Supplier make any change, modification, addition or deletion to, in or from the Deliverables (hereinafter referred to as "Change"), provided that such Change falls within the general scope of the Deliverables and does not constitute unrelated work that is technically impracticable, taking into account both the state of advancement of the Works and the technical compatibility of the Change envisaged with the nature of the Deliverables as specified in the Contract. The Supplier shall be obliged to execute such Change in accordance with the terms of this Contract. 38.1.2 The Supplier may from time to time during its performance of the Contract propose to HPC (with a copy to the HPM) any Change that the Supplier considers necessary or desirable to improve the quality, efficiency or safety of the Deliverables. HPC may at its sole discretion approve or reject any Change proposed by the Supplier. 38.1.3 Notwithstanding Sub-Clauses 38.1.1 and 38.1.2, no change that (i) is made necessary because of any failure or default or breach of the Supplier in the performance of its obligations under the Contract, (ii) or is made due to any other circumstances depending on the Supplier, or

  • TERMINATION OF EFT SERVICES You may terminate this Agreement or any EFT service under this Agreement at any time by notifying us in writing and stopping your use of your card and any access code. You must return all cards to the Credit Union. You also agree to notify any participating merchants that authority to make ▇▇▇▇ payment transfers has been revoked. We may also terminate this Agreement at any time by notifying you orally or in writing. If we terminate this Agreement, we may notify any participating merchants making preauthorized debits or credits to any of your accounts that this Agreement has been terminated and that we will not accept any further preauthorized transaction instructions. We may also program our computer not to accept your card or access code for any EFT service. Whether you or the Credit Union terminates this Agreement, the termination shall not affect your obligations under this Agreement for any electronic transactions made prior to termination.

  • Approved Services; Additional Services Registry Operator shall be entitled to provide the Registry Services described in clauses (a) and (b) of the first paragraph of Section 2.1 in the Specification 6 attached hereto (“Specification 6”) and such other Registry Services set forth on Exhibit A (collectively, the “Approved Services”). If Registry Operator desires to provide any Registry Service that is not an Approved Service or is a material modification to an Approved Service (each, an “Additional Service”), Registry Operator shall submit a request for approval of such Additional Service pursuant to the Registry Services Evaluation Policy at ▇▇▇▇://▇▇▇.▇▇▇▇▇.▇▇▇/en/registries/rsep/rsep.html, as such policy may be amended from time to time in accordance with the bylaws of ICANN (as amended from time to time, the “ICANN Bylaws”) applicable to Consensus Policies (the “RSEP”). Registry Operator may offer Additional Services only with the written approval of ICANN, and, upon any such approval, such Additional Services shall be deemed Registry Services under this Agreement. In its reasonable discretion, ICANN may require an amendment to this Agreement reflecting the provision of any Additional Service which is approved pursuant to the RSEP, which amendment shall be in a form reasonably acceptable to the parties.

  • Interconnection Customer Compensation If the CAISO requests or directs the Interconnection Customer to provide a service pursuant to Articles 9.6.3 (Payment for Reactive Power) or 13.5.1 of this LGIA, the CAISO shall compensate the Interconnection Customer in accordance with the CAISO Tariff.

In no event shall Provider dispose of data pursuant to this provision unless and until Provider has received affirmative written confirmation from LEA that data will not be transferred to a separate account.
