Common use of Changes to GMP Clause in Contracts

Changes to GMP. Subject to the condition precedent that the Contractor have complied with the notice and documentation provisions of this Article, and subject to the limitations stated in this Agreement, the Contractor is entitled to an adjustment to 1. If the Department issues a Change Directive or Change Order that directs the Contractor to proceed with work which is beyond the scope of work included within this Agreement; or 2. The Contractor encounters Differing Site Conditions or Hazardous Materials not identified in the Preconstruction Phase.

If the Department issues a Change Directive or Change Order that directs the Contractor Design-Builder to proceed with work which is beyond the scope of work Work included within this Agreement; or 2. The Contractor Design-Builder encounters Differing Site Conditions or Hazardous Materials not identified in the Preconstruction Phase.
