6.07 All money being earned by the employee including wages, the Employer's contribution to the CLAC Health Fund, the Pension Plan, allowances, as well as deductions made from the employee's wages, such as Union dues, will be considered trust monies held on behalf of the employee until the money is paid to the employee or the Union in the manner indicated in this Collective Agreement.
6.08 All contributions and deductions pursuant to Article 12 - Health and Welfare Plan, Article 13 - Pension Plan, Article 17 - Education and Training Fund, and Article 18 - Industry Fund shall be remitted together with and in the manner described for Union dues, as set out here in Article 6.

7.03 The Union shall hold harmless, and agrees to indemnify the Employer, its successors, administrators and assigns against any liability incurred by each of them by reason of having made any deductions, remittances, or payments required by this Agreement.
7.04 The Employer shall remit dues on a form prescribed by the Union and shall include on such remittance the following information for each employee:
a. name;
b. rate of pay;

The total amount(s) deducted on behalf of the Union will be remitted by the Employer to the Union by the fifteenth (15th) day of the each month following the month in for which such dues the monies were deducted, together with an itemized list of the employees for whom the deductions are deductedmade and the amount remitted for each.

d. total regular and overtime hours worked in the month for which such deductions are made. (If an employee earned overtime premiums these hours shall be recorded separately);
e. dues or fees deducted and remitted on behalf of the employee as may be prescribed by the Union; and;
f. contributions on behalf of the employee and any deductions from and remitted for an employee as may be prescribed by this Agreement;
g. work location/job site;
h. any hourly premiums;
i. Social Insurance Number; and j. date of birth.
7.05 When the Employer hires new employees who are not members of the Union, the Employer shall also include on the next remittance, the following information of the employee involved:
a. complete mailing address;
b. primary telephone;
▇. ▇▇▇▇ of hire;
d. classification, including trade certificate number and apprenticeship level or year; and,
e. e-mail address.
7.07 Employees who cannot support the Union with their dues for reasons of conscience, as determined by the Union’s internal guidelines of what constitutes a conscientious objection, may apply to the Union, in writing, to have their dues redirected. Such applications shall outline the nature of the conscientious objection.
7.08 The Employer shall also record on a remittance any of the
a. Change in classification, level or apprenticeship year; or
b. Job end date (for temporary, or permanent separation).
7.09 All contributions and deductions pursuant to Article 16 – CLAC Health Fund, Article 17 – Pension Plan, Article 18 – Education and Assistance Fund, and Article 19 – Construction Industry Development and Promotion Fund shall be remitted together with and in the manner described for Union dues, as set out here in Article 7 – Check Off and Union Membership.

CHECK OFF AND UNION MEMBERSHIP. 7.01 5.01 The Employer will deduct from each employee covered by this Agreement an amount equal to the regular monthly Union dues designated by the Union in writing. The Employer will also deduct any designated initiation fees.
5.02 Such dues shall be deducted bi-weekly and, in the case of newly hired employees, such deductions shall commence in the month following their date of hire.
a. The amount of the regular monthly dues and initiation fees shall be those authorized by the Union and the Union shall notify the Employer in writing of any changes therein and such notification shall be the Employer's conclusive authority to make the deduction specified.
b. Employees who have not worked in a month and are off work for whatever reason for one month or more shall, upon return to work, be deducted only one (1) month's back dues or an amount equal to dues in addition to the regular deductions.
5.04 In consideration of the deducting and forwarding of Union dues by the Employer, the Union agrees to indemnify and save the Employer harmless against any claims or liabilities arising or resulting from the operation of this Article.
5.05 The amounts so deducted shall be remitted monthly to the Union no later than the end of the third (3rd) week in the month following the month in which the dues were deducted.
5.06 Neither the Employer nor the Union will compel employees to become members of join the Union. The Employer and the Union agree that there will not discriminate against employees be no discrimination exercised or practised by any of their representatives with respect to any employee because of Union their membership or lack thereof, and it will inform all new employees of the contractual relationship with non-membership in the Union.
