The Choice of Plan clause establishes which specific plan, policy, or program will govern the rights and obligations of the parties involved. Choice of Plan. 9 To the extent members are permitted to choose from among two (2) or 10 more medical insurance plans, retirees shall be permitted to choose between the same 11 plans under the same conditions and at the same times as apply to members. Retirees 12 participating in the members' medical insurance plan shall be subject to the application of 13 any change or elimination of benefits, carrier, administrator or administrative procedure to 14 the same extent and at the same time as members.

To the extent Subscriber shall wish to receive access to additional features and functionalities of the Platform and Services, Subscriber shall be required to register and subscribe for one of Aliyoop’s paid plans, pursuant to which Subscriber shall be required to provide its credit card details as set forth in Section 2.3 below, and pay to Aliyoop due consideration for use of the Platform and Services in accordance with Aliyoops then current price list, as further described herein.

  • Choice of Venue If there is a lawsuit. ▇▇▇▇▇▇▇▇ agrees upon ▇▇▇▇▇▇'s request to submit to the jurisdiction of the courts of Allegheny County, Commonwealth of Pennsylvania. No Waiver by ▇▇▇▇▇▇. No delay or omission on the part of Lender in exercising any right shall operate as a waiver of such right or any other right. No prior waiver by ▇▇▇▇▇▇, nor any course of dealing between ▇▇▇▇▇▇ and Borrower, or between Lender and any Grantor, shall constitute a waiver of any of Lender's rights or of any of Borrower's or any Grantor's obligations as to any future transactions. Whenever the consent of Lender is required under this Agreement, the granting of such consent by Lender in any instance shall not constitute continuing consent to subsequent instances where such consent is required and in all cases such consent may be granted or withheld in the sole discretion of Lender.

  • Governing Law; Choice of Venue This Agreement shall be governed by and interpreted in accordance with the laws of the State of Delaware, without giving effect to the principles of the conflicts of laws thereof. For purposes of litigating any dispute that arises directly or indirectly from the relationship of the parties, evidenced by this Award or the Agreement, the parties hereby submit to and consent to the exclusive jurisdiction of the State of North Carolina and agree that such litigation shall be conducted only in the courts of Wake County, North Carolina, or the federal courts for the United States for the Tenth District of North Carolina, and no other courts, where this Award is made and/or to be performed.
