Common use of Claims and Demands Clause in Contracts

Claims and Demands. Except as disclosed in writing to the Village, there are no material and adverse claims and demands based in environmental, contract or tort law pending or, to the best of the Company's knowledge, threatened against the Company, the Affiliates or the Guarantors, with respect to any wastewater treatment or water facility providing service to the general public designed, constructed, operated, maintained or managed by the Company.
