Common use of Claims Not Released Clause in Contracts

Claims Not Released. The Released Claims do not include claims by Executive for: (i) unemployment insurance; (ii) worker’s compensation benefits; (iii) state disability compensation; (iv) previously vested benefits under any the Company-sponsored benefits plan; and (v) any other rights that cannot by law be released by private agreement.

Claims Not Released. The Released Claims do not include claims by Executive Employee for: (i1) unemployment insurance; (ii2) worker’s compensation benefits; (iii3) state disability compensation; (iv4) previously vested benefits under any the Company-sponsored benefits plan; and (v5) any other rights that cannot by law be released by private agreement.

Claims Not Released. The Released Claims do not include claims by Executive for: (i1) unemployment insurancepayment of the Severance or reimbursements due under the Employment Agreement; (ii) worker’s compensation benefits; (iii) state disability compensation; (iv2) previously vested benefits under any the Company-sponsored benefits plan, including without limitation the equity awards granted pursuant to Section 4 of the Employment Agreement; (3) indemnification and advancement of expenses under the Company’s certificate of incorporation or bylaws, and (v4) any other rights that cannot by law be released by private agreement.

Claims Not Released. The Released Claims do not include claims by Executive for: (i1) unemployment insurance; (ii2) worker’s compensation benefits; (iii3) state disability compensation; (iv4) previously vested benefits Accrued Amounts ; (5) any rights for indemnification or contribution under the Company’s certificate of incorporation or by-laws, the laws of the state of incorporation or any rights to insurance coverage under any the Company-sponsored benefits plan; applicable directors’ and officers’ liability insurance policy and (v6) any other rights that cannot by law be released by private agreement.

Claims Not Released. The Released Claims do not include claims by Executive Grantee for: (i1) unemployment insurancecompensation; (ii2) worker’s compensation benefits; (iii) state disability compensation; (iv3) previously vested benefits under any the Company-sponsored benefits plan; and (v4) any other rights or claims that cannot by law be released by private agreement.

Claims Not Released. The Released Claims do not include claims by Executive for: (i1) unemployment insurancepayment of the Severance Payment under the Employment Agreement; (ii) worker’s compensation benefits; (iii) state disability compensation; (iv2) previously vested benefits under any the Company-sponsored benefits plan, including without limitation the equity awards granted pursuant to Section 4 of the Employment Agreement; (3) any rights under the Existing Agreements or for indemnification and advancement of expenses under the Company’s certificate of incorporation or Bylaws, and (v4) any other rights that cannot by law be released by private agreement.

Claims Not Released. The Released Claims do not include claims by Executive for: (i) for unemployment insurance; (ii) worker’s insurance benefits, workers’ compensation benefits; (iii) state disability compensation; (iv) , previously vested benefits under any the Company-sponsored benefits plan; and (v) plan or any other rights that cannot by law be released by private agreement.

Claims Not Released. The Released Claims do not include claims by Executive for: (i) unemployment insurancethe Separation Benefits; (ii) worker’s compensation benefits; (iii) state disability compensation; (iv) his “Compensation Accrued at Termination” as defined in the Employment Agreement, including previously vested benefits under any the Company-sponsored benefits benefit plan; (iii) rights under Executive’s indemnification agreement with the Company, and (viv) any other rights that cannot by law be released by private agreement.

Claims Not Released. The Released Claims do not include claims by Executive for: (i1) unemployment insurance; (ii2) worker’s compensation benefits; (iii3) state disability compensation; (iv4) previously vested benefits under any the Company-sponsored benefits planplan of the Company or its parent or affiliates; and (v5) any other rights that cannot by law be released by private agreement.

Claims Not Released. The Released Claims do not include claims by Executive Employee for: (i1) unemployment insurance; (ii2) worker’s compensation benefits; (iii3) state disability compensation; (iv4) previously vested benefits under any the Company-sponsored benefits plan; (5) enforcing this Agreement; and (v6) any other rights that cannot by law be released by private agreement.

Claims Not Released. The Released Claims do not include claims by Executive for: (i1) unemployment insurance; (ii2) worker’s compensation benefits; (iii3) state disability compensation; (iv4) previously vested benefits under any the Company-sponsored benefits planplan of the Company or its parent or affiliates; and (v5) any other rights that cannot by law be released by private agreement; (6) any indemnification rights Executive may have under applicable law, the Company’s incorporation documents or bylaws, or any agreement, or any right to coverage under the Company’s directors and officers insurance, and (7) any claim that arises after this Agreement is executed.

Claims Not Released. The Released Claims do not include claims by Executive for: (i1) unemployment insurancepayment of the Severance or reimbursements due under the Employment Agreement; (ii) worker’s compensation benefits; (iii) state disability compensation; (iv2) previously vested benefits under any the Company-sponsored benefits plan, including without limitation the equity awards granted pursuant to Section 4 of the Employment Agreement; (3) indemnification and advancement of expenses under the Company's certificate of incorporation or bylaws, and (v4) any other rights that cannot by law be released by private agreement.

Claims Not Released. The Released Claims do not include claims by Executive for: (i1) unemployment insurance; (ii2) worker’s compensation benefits; (iii3) state disability compensation; (iv4) previously vested benefits under any the Company-sponsored benefits plan; (5) challenging the validity of this release pursuant to the Age Discrimination in Employment Act; and (v6) any other rights that cannot by law be released by private agreement.

Claims Not Released. The Released Claims do not include claims by Executive for: (i) unemployment insurance; (ii) worker’s workers’ compensation benefits; (iii) state disability compensation; (iv) previously vested benefits under any the Company-sponsored benefits plan; (v) indemnity under the Indemnification Agreement or any other written indemnity agreement between the Company and Executive; and (vvi) any other rights that cannot by law be released by private agreement.
