Common use of Class Action Fairness Act (“CAFA”) Notice Clause in Contracts

Class Action Fairness Act (“CAFA”) Notice. The Parties agree that the Defendant shall serve notice of the settlement at Defendant’s expense that meets the requirements of CAFA, 28 U.S.C. § 1715, on the appropriate federal and state officials not later than ten (10) days after the filing of this Settlement Agreement with the Court. Defendant may use a third-party to serve the CAFA Notice, in Defendant’s discretion.
