Common use of Class Compensation Clause in Contracts

Class Compensation. Defendant has created a settlement fund totaling $360,000.00 (the “Settlement Fund”) to pay valid Settlement Class member claims on a pro rata basis, to pay an incentive award to Plaintiff for serving as the Class Representative, to pay Class Counsel’s attorneys’ fees and reasonable litigation expenses, and to pay the costs incurred by the Settlement Administrator for notifying the Settlement Class and administering the Settlement Fund.

Class Compensation. Defendant has created a settlement fund totaling of $360,000.00 6,000,000.00 (the “Settlement Fund”) and made it available to pay valid Settlement Class member claims on a pro rata basismembers, to pay an incentive award to Plaintiff for serving as the Class Representative, and to pay Class Counsel’s attorneys’ fees and reasonable litigation out-of-pocket expenses, and to pay including class administrative fees. None of the costs incurred by monies in the Settlement Administrator for notifying the Settlement Class and administering the Settlement FundFund will revert back to Defendant.
