Common use of Class Definitions Clause in Contracts

Class Definitions. For the purpose of the definition of the Settlement Classes, the “Class Period” is, except as set forth immediately below with respect to persons who resided at St. Luke (as defined below), September 1, 2003, through and including the Settlement Date. The Settlement Classes consist of two classes and a subclass, namely: (1) the “Facility Resident Class” with a “Private Pay Subclass,” and (2) the “Family Member Class,” as those terms are defined below; provided, however, that the Settlement Classes shall exclude all persons identified on Exhibit A to the Declaration of ▇▇▇▇▇▇ ▇▇▇▇▇ Re: Resident Opt-Out List filed with the Court on or about February 23, 2010, unless any such person: (i) resided at a Defendant Facility from April 2, 2009 through and including the Settlement Date; or (ii) are related to any person referenced in the immediately preceding subparagraph (i) by blood, marriage or legal relationship and paid monies to the Defendants, or any of them, for services rendered at a Defendant Facility from April 2, 2009, through and including the Settlement Date.
