Class Settlement Website. 25 6.3.1. The Class Action Administrator will create and maintain a class 26 settlement website (the “Class Settlement Website”), to be activated within seven (7) calendar 27 days of its receipt of the Preliminary Approval Order. The Class Settlement Website will contain 1 Settlement information and case-related documents such as this Settlement Agreement, the 2 Preliminary Approval Order, the Notice, the Motion for Attorneys’ Fees, Costs and Incentive 3 Award, the Final Approval Motion, and notices from the Court. In addition, the Class Settlement 4 Website will include procedural information regarding the status of the Court-approval process, 5 such as an announcement of the Fairness Hearing date, when the Final Judgment and Order has 6 been entered, and when the Effective Date has been reached, including any appeal(s). 7 6.3.2. The Class Settlement Website will terminate (be removed from the 8 internet) and no longer be maintained by the Class Action Administrator on either (a) the 9 Effective Date or (b) the date on which the Settlement Agreement is terminated or otherwise not 10 approved by a court, whichever is later.

In addition, the Class Settlement 4 Website will include procedural information regarding the status of the Court-approval process, 5 such as an announcement of the Fairness Hearing date, when the Final Judgment and Order has 6 been entered, and when the Effective Date has been reached, including any appeal(s). 7 6.3.2. 6.3.2 The Class Settlement Website will terminate (be removed from the 8 internet) and no longer be maintained by the Class Action Administrator on either the later of: (a) the 9 Effective Date date on which the Defendant modifies its main FAQ page and FAQ Nutrition Page as described in Paragraph 4.1.3 or (b) the date on which the Settlement Agreement is terminated or otherwise not 10 approved by a court, whichever is later.
