Common use of CLEC Certification Clause in Contracts

CLEC Certification. 1.1 CTI agrees to provide BellSouth in writing CTI’s CLEC certification from the Commission for all states covered by this Agreement prior to BellSouth filing this Agreement with the appropriate Commission for approval. Additionally, CTI shall provide to BellSouth an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement. 1.2 To the extent CTI is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, CTI may not purchase services hereunder in that state. CTI will notify BellSouth in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of state or equivalent authority for, any other state covered by this Agreement. Upon receipt thereof, BellSouth will file this Agreement in that state, and CTI may purchase services pursuant to this Agreement in that state, subject to establishing appropriate accounts in the additional state as described in Attachment 3. 1.3 Should CTI’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided in that state shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. CTI shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

CLEC Certification. 1.1 CTI FamilyTel agrees to provide BellSouth ▇▇▇▇▇▇▇▇▇ in writing CTIFamilyTel’s CLEC certification from the Commission for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate Commission for approval. Additionally, CTI FamilyTel shall provide to BellSouth an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement. 1.2 To the extent CTI FamilyTel is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, CTI FamilyTel may not purchase services hereunder in that state. CTI FamilyTel will notify BellSouth in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of state or equivalent authority for, any other state covered by this Agreement. Upon receipt thereof, BellSouth will file this Agreement in that state, and CTI FamilyTel may purchase services pursuant to this Agreement in that state, subject to establishing appropriate accounts in the additional state as described in Attachment 37. 1.3 Should CTIFamilyTel’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately in such state and all monies owed on all outstanding invoices for services provided in that such state shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. CTI FamilyTel shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

CLEC Certification. 1.1 CTI CM Tel agrees to provide BellSouth in writing CTICM Tel’s CLEC certification from the Commission for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate Commission for approval. Additionally, CTI CM Tel shall provide to BellSouth an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement. 1.2 To the extent CTI CM Tel is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, CTI CM Tel may not purchase services hereunder in that state. CTI CM Tel will notify BellSouth in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of state or equivalent authority for, any other state covered by this Agreement. Upon receipt thereof, BellSouth will file this Agreement in that state, and CTI CM Tel may purchase services pursuant to this Agreement in that state, subject to establishing appropriate accounts in the additional state as described in Attachment 3. 1.3 Should CTICM Tel’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided in that state shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. CTI CM Tel shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

Additionally, CTI Gildra’s shall provide to BellSouth an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement. 1.2 To the extent CTI Gildra’s is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, CTI Gildra’s may not purchase services hereunder in that state. CTI Gildra’s will notify BellSouth in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of state or equivalent authority for, any other state covered by this Agreement. Upon receipt thereof, BellSouth will file this Agreement in that state, and CTI Gildra’s may purchase services pursuant to this Agreement in that state, subject to establishing appropriate accounts in the additional state as described in Attachment 3. 1.3 Should CTIGildra’s’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided in that state shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. CTI Gildra’s shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

CLEC Certification. 1.1 CTI Express Phone agrees to provide BellSouth in writing CTIExpress Phone’s CLEC certification from the Commission for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate Commission for approval. Additionally, CTI Express Phone shall provide to BellSouth an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement. 1.2 To the extent CTI Express Phone is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, CTI Express Phone may not purchase services hereunder in that state. CTI Express Phone will notify BellSouth in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of state or equivalent authority for, any other state covered by this Agreement. Upon receipt thereof, BellSouth will file this Agreement in that state, and CTI Express Phone may purchase services pursuant to this Agreement in that state, subject to establishing appropriate accounts in the additional state as described in Attachment 3. 1.3 Should CTIExpress Phone’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided in that state shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. CTI Express Phone shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

CLEC Certification. 1.1 CTI FPB agrees to provide BellSouth in writing CTIFPB’s CLEC certification from the Commission for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate Commission for approval. Additionally, CTI FPB shall provide to BellSouth an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement. 1.2 To the extent CTI FPB is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, CTI FPB may not purchase services hereunder in that state. CTI FPB will notify BellSouth in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of state or equivalent authority for, any other state covered by this Agreement. Upon receipt thereof, BellSouth will file this Agreement in that state, and CTI FPB may purchase services pursuant to this Agreement in that state, subject to establishing appropriate accounts in the additional state as described in Attachment 37. 1.3 Should CTIFPB’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided in that state shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. CTI FPB shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

CLEC Certification. 1.1 CTI Home Phone agrees to provide BellSouth in writing CTIHome Phone’s CLEC certification from the Commission for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate Commission for approval. Additionally, CTI Home Phone shall provide to BellSouth an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement. 1.2 To the extent CTI Home Phone is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, CTI Home Phone may not purchase services hereunder in that state. CTI Home Phone will notify BellSouth in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of state or equivalent authority for, any other state covered by this Agreement. Upon receipt thereof, BellSouth will file this Agreement in that state, and CTI Home Phone may purchase services pursuant to this Agreement in that state, subject to establishing appropriate accounts in the additional state as described in Attachment 3. 1.3 Should CTIHome Phone’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided in that state shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. CTI Home Phone shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

Additionally, CTI Excel PCHP shall provide to BellSouth an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement. 1.2 To the extent CTI Excel PCHP is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, CTI Excel PCHP may not purchase services hereunder in that state. CTI Excel PCHP will notify BellSouth in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of state or equivalent authority for, any other state covered by this Agreement. Upon receipt thereof, BellSouth will file this Agreement in that state, and CTI Excel PCHP may purchase services pursuant to this Agreement in that state, subject to establishing appropriate accounts in the additional state as described in Attachment 3. 1.3 Should CTIExcel PCHP’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided in that state shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. CTI Excel PCHP shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

CLEC Certification. 1.1 CTI BudgeTel agrees to provide BellSouth in writing CTIBudgeTel’s CLEC certification from the Commission for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate Commission for approval. Additionally, CTI BudgeTel shall provide to BellSouth an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement. 1.2 To the extent CTI BudgeTel is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, CTI BudgeTel may not purchase services hereunder in that state. CTI BudgeTel will notify BellSouth in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of state or equivalent authority for, any other state covered by this Agreement. Upon receipt thereof, BellSouth will file this Agreement in that state, and CTI BudgeTel may purchase services pursuant to this Agreement in that state, subject to establishing appropriate accounts in the additional state as described in Attachment 3. 1.3 Should CTIBudgeTel’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided in that state shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. CTI BudgeTel shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

CLEC Certification. 1.1 CTI Telephone One agrees to provide BellSouth in writing CTITelephone One’s CLEC certification from the Commission for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate Commission for approval. Additionally, CTI Telephone One shall provide to BellSouth an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement. 1.2 To the extent CTI Telephone One is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, CTI Telephone One may not purchase services hereunder in that state. CTI Telephone One will notify BellSouth in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of state or equivalent authority for, any other state covered by this Agreement. Upon receipt thereof, BellSouth will file this Agreement in that state, and CTI Telephone One may purchase services pursuant to this Agreement in that state, subject to establishing appropriate accounts in the additional state as described in Attachment 3. 1.3 Should CTITelephone One’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided in that state shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. CTI Telephone One shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

CLEC Certification. 1.1 CTI Global Dialtone agrees to provide BellSouth in writing CTIGlobal Dialtone’s CLEC certification from the Commission for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate Commission for approval. Additionally, CTI shall provide to BellSouth an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement. 1.2 To the extent CTI Global Dialtone is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, CTI Global Dialtone may not purchase services hereunder in that state. CTI Global Dialtone will notify BellSouth in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of state or equivalent authority for, in any other state covered by this Agreement. Upon Agreement and upon receipt thereof, BellSouth will file this Agreement in that state, and CTI Global Dialtone may thereafter purchase services pursuant to this Agreement in that state, subject to establishing . BellSouth will file this Agreement with the appropriate accounts in the additional state as described in Attachment 3Commission for approval. 1.3 Should CTIGlobal Dialtone’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided in that state shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. CTI Global Dialtone shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

CLEC Certification. 1.1 CTI Airespring agrees to provide BellSouth in writing CTIAirespring’s CLEC certification from the Commission for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate Commission for approval. Additionally, CTI Airespring shall provide to BellSouth an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement. 1.2 To the extent CTI Airespring is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, CTI Airespring may not purchase services hereunder in that state. CTI Airespring will notify BellSouth in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of state or equivalent authority for, any other state covered by this Agreement. Upon receipt thereof, BellSouth will file this Agreement in that state, and CTI Airespring may purchase services pursuant to this Agreement in that state, subject to establishing appropriate accounts in the additional state as described in Attachment 3. 1.3 Should CTIAirespring’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided in that state shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. CTI Airespring shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

CLEC Certification. 1.1 CTI Title Pawn agrees to provide BellSouth in writing CTITitle Pawn’s CLEC certification from the Commission for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate Commission for approval. Additionally, CTI Title Pawn shall provide to BellSouth an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement. 1.2 To the extent CTI Title Pawn is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, CTI Title Pawn may not purchase services hereunder in that state. CTI Title Pawn will notify BellSouth in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of state or equivalent authority for, any other state covered by this Agreement. Upon receipt thereof, BellSouth will file this Agreement in that state, and CTI Title Pawn may purchase services pursuant to this Agreement in that state, subject to establishing appropriate accounts in the additional state as described in Attachment 37. 1.3 Should CTITitle Pawn’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided in that state shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. CTI Title Pawn shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

Additionally, CTI RGW shall provide to BellSouth an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement. 1.2 To the extent CTI RGW is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, CTI RGW may not purchase services hereunder in that state. CTI RGW will notify BellSouth in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of state or equivalent authority for, any other state covered by this Agreement. Upon receipt thereof, BellSouth will file this Agreement in that state, and CTI RGW may purchase services pursuant to this Agreement in that state, subject to establishing appropriate accounts in the additional state as described in Attachment 37. 1.3 Should CTIRGW’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided in that state shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. CTI RGW shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

Additionally, CTI ComSouth shall provide to BellSouth an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement. 1.2 To the extent CTI ComSouth is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, CTI ComSouth may not purchase services hereunder in that state. CTI ComSouth will notify BellSouth in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of state or equivalent authority for, any other state covered by this Agreement. Upon receipt thereof, BellSouth will file this Agreement in that state, and CTI ComSouth may purchase services pursuant to this Agreement in that state, subject to establishing appropriate accounts in the additional state as described in Attachment 37. 1.3 Should CTIComSouth’s Commission/CLEC certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided in that state shall become due, or BellSouth may refuse to provide services hereunder in that state until Commission/CLEC certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. CTI Additionally, once Commission//CLEC certification is reinstated, ComSouth shall again provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

CLEC Certification. 1.1 CTI Rent-A-Line agrees to provide BellSouth in writing CTIRent-A-Line’s CLEC certification from the Commission for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate Commission for approval. Additionally, CTI Rent-A-Line shall provide to BellSouth an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement. 1.2 To the extent CTI Rent-A-Line is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, CTI Rent-A-Line may not purchase services hereunder in that state. CTI Rent-A-Line will notify BellSouth in writing and provide CLEC certification from the Commission when it becomes certified to operate in, as well as an effective certification to do business issued by the secretary of state or equivalent authority for, any other state covered by this Agreement. Upon receipt thereof, BellSouth will file this Agreement in that state, and CTI Rent-A-Line may purchase services pursuant to this Agreement in that state, subject to establishing appropriate accounts in the additional state as described in Attachment 3. 1.3 Should CTIRent-A-Line’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided in that state shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. CTI Rent-A- Line shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.
