Common use of CLEC Certification Clause in Contracts

CLEC Certification. 1.1 Credit Loans agrees to provide BellSouth in writing Credit Loans’s CLEC certification for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate Commission for approval. 1.2 To the extent Credit Loans is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, Credit Loans may not purchase services hereunder in that state. Credit Loans will notify BellSouth in writing and provide CLEC certification when it becomes certified to operate in any other state covered by this Agreement and upon receipt thereof, Credit Loans may thereafter purchase services pursuant to this Agreement in that state. BellSouth will file this Agreement with the appropriate Commission for approval. 1.3 Should Credit Loans’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, terminate this Agreement immediately and all monies owed on all outstanding invoices shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. Credit Loans shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

CLEC Certification. 1.1 Credit Loans Metro Teleconnect agrees to provide BellSouth in writing Credit LoansMetro Teleconnect’s CLEC certification for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate Commission for approval. 1.2 To the extent Credit Loans Metro Teleconnect is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, Credit Loans Metro Teleconnect may not purchase services hereunder in that state. Credit Loans Metro Teleconnect will notify BellSouth in writing and provide CLEC certification when it becomes certified to operate in any other state covered by this Agreement and upon receipt thereof, Credit Loans Metro Teleconnect may thereafter purchase services pursuant to this Agreement in that state. BellSouth will file this Agreement with the appropriate Commission for approval. 1.3 Should Credit LoansMetro Teleconnect’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, terminate this Agreement immediately and all monies owed on all outstanding invoices shall become due, or and BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the initial term of this Agreement. Credit Loans Metro Teleconnect shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

Credit Loans TeraBlue will notify BellSouth in writing and provide CLEC certification when it becomes certified to operate in any other state covered by this Agreement and upon receipt thereof, Credit Loans TeraBlue may thereafter purchase services pursuant to this Agreement in that state. BellSouth will file this Agreement with the appropriate Commission for approval. 1.3 Should Credit LoansTeraBlue’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately and all monies owed on all outstanding invoices for services provided shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. Credit Loans TeraBlue shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

Credit Loans Easy Telephone will notify BellSouth in writing and provide CLEC certification when it becomes certified to operate in any other state covered by this Agreement and upon receipt thereof, Credit Loans Easy Telephone may thereafter purchase services pursuant to this Agreement in that state. Credit Loans American Telecharge will notify BellSouth in writing and provide CLEC certification when it becomes certified to operate in any other state covered by this Agreement and upon receipt thereof, Credit Loans American Telecharge may thereafter purchase services pursuant to this Agreement in that state. Credit Loans American Telecharge shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

Credit Loans CloseCall shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

Credit Loans AM-TEL will notify BellSouth in writing and provide CLEC certification when it becomes certified to operate in any other state covered by this Agreement and upon receipt thereof, Credit Loans AM-TEL may thereafter purchase services pursuant to this Agreement in that state. BellSouth will file this Agreement with the appropriate Commission for approval. 1.3 Should Credit LoansAM-TEL’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, terminate this Agreement immediately and all monies owed on all outstanding invoices shall become due, or and BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. Credit Loans AM-TEL shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

Credit Loans Telecable will notify BellSouth in writing and provide CLEC certification when it becomes certified to operate in any other state covered by this Agreement and upon receipt thereof, Credit Loans Telecable may thereafter purchase services pursuant to this Agreement in that state. BellSouth will file this Agreement with the appropriate Commission for approval. 1.3 Should Credit LoansTelecable’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, suspend or terminate this Agreement immediately in such state and all monies owed on all outstanding invoices for services provided in such state shall become due, or BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. Credit Loans Fast Phones will notify BellSouth in writing and provide CLEC certification when it becomes certified to operate in any other state covered by this Agreement and upon receipt thereof, Credit Loans Fast Phones may thereafter purchase services pursuant to this Agreement in that state. BellSouth will file this Agreement with the appropriate Commission for approval. 1.3 Should Credit LoansFast Phones’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, terminate this Agreement immediately and all monies owed on all outstanding invoices shall become due, or and BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the initial term of this Agreement. Credit Loans Fast Phones shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

Credit Loans TWTC will notify BellSouth in writing and provide CLEC certification when it becomes certified to operate in any other state covered by this Agreement and upon receipt thereof, Credit Loans TWTC may thereafter purchase services pursuant to this Agreement in that state. BellSouth will file this Agreement with the appropriate Commission for approval. 1.3 Should Credit LoansTWTC’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, terminate this Agreement immediately and all monies owed on all outstanding invoices shall become due, or and BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the initial term of this Agreement. Credit Loans TWTC shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

CLEC Certification. 1.1 Credit Loans Universal Telecom, Inc agrees to provide BellSouth in writing Credit LoansUniversal Telecom, Inc’s CLEC certification for all states covered by this Agreement except Kentucky prior to BellSouth filing this Agreement with the appropriate Commission for approval. 1.2 To the extent Credit Loans Universal Telecom, Inc is not certified as a CLEC in each state covered by this Agreement as of the execution hereof, Credit Loans Universal Telecom, Inc may not purchase services hereunder in that state. Credit Loans Universal Telecom, Inc will notify BellSouth in writing and provide CLEC certification when it becomes certified to operate in any other state covered by this Agreement and upon receipt thereof, Credit Loans Universal Telecom, Inc may thereafter purchase services pursuant to this Agreement in that state. BellSouth will file this Agreement with the appropriate Commission for approval. 1.3 Should Credit LoansUniversal Telecom, Inc’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, terminate this Agreement immediately and all monies owed on all outstanding invoices shall become due, or and BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the initial term of this Agreement. Credit Loans Universal Telecom, Inc shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.

Credit Loans Express Paging will notify BellSouth in writing and provide CLEC certification when it becomes certified to operate in any other state covered by this Agreement and upon receipt thereof, Credit Loans Express Paging may thereafter purchase services pursuant to this Agreement in that state. BellSouth will file this Agreement with the appropriate Commission for approval. 1.3 Should Credit LoansExpress Paging’s certification in any state be rescinded or otherwise terminated, BellSouth may, at its election, terminate this Agreement immediately and all monies owed on all outstanding invoices shall become due, or and BellSouth may refuse to provide services hereunder in that state until certification is reinstated in that state, provided such notification is made prior to expiration of the term of this Agreement. Credit Loans Express Paging shall provide an effective certification to do business issued by the secretary of state or equivalent authority in each state covered by this Agreement.
