Common use of Client Records Clause in Contracts

Client Records. 20 23.2.1 CONTRACTOR shall prepare and maintain accurate and complete records 21 of clients served and dates and type of services provided under the terms of this Agreement in a 22 form acceptable to ADMINISTRATOR. 23 23.2.2 CONTRACTOR shall keep all COUNTY data provided to CONTRACTOR 24 during the term(s) of this Agreement for a minimum of five (5) years from the date of final payment 25 under this Agreement, or until all pending County, State, and federal audits are completed, 26 whichever is later. These records shall be stored in Orange County, unless CONTRACTOR 27 requests and COUNTY provides written approval for the right to store the records in another 28 county. Notwithstanding anything to the contrary, upon termination of this Agreement, 1 CONTRACTOR shall relinquish control with respect to COUNTY data to COUNTY in 2 accordance with Subparagraph 39.2. 3 23.2.3 COUNTY may refuse payment for a claim if client records are determined 4 by COUNTY to be incomplete or inaccurate. In the event client records are determined to be 5 incomplete or inaccurate after payment has been made, COUNTY may treat such payment as an 6 overpayment within the provisions of this Agreement.

Notwithstanding anything to 21 under this Agreement or until all pending COUNTY, State and Federal audits are 22 COUNTY data 25 the contrary, upon termination of this Agreement, 1 CONTRACTOR shall relinquish 26 control with respect to COUNTY data client records 27 with Subparagraph 43.2. to COUNTY in 2 accordance with Subparagraph 39.2. 3 23.2.3 28 24.2.3 COUNTY may refuse payment for a claim if client records CAB2417) (CMS0214 1 are determined 4 by COUNTY to be incomplete or inaccurate. In the event client 2 records are determined to be 5 incomplete or inaccurate after payment has been 3 made, COUNTY may treat such payment as an 6 overpayment within the provisions of 4 this Agreement.

Client Records. 20 23.2.1 5 25.2.1 CONTRACTOR shall prepare and maintain accurate and complete records 21 6 of clients served and dates and type of services provided under the terms of this Agreement in a 22 7 form acceptable to ADMINISTRATOR. 23 23.2.2 8 25.2.2 CONTRACTOR shall keep all COUNTY data provided to CONTRACTOR 24 9 during the term(s) of this Agreement for a minimum of five (5) years from the date of final payment 25 10 under this Agreement, or until all pending CountyCOUNTY, State, and federal audits are completed, 26 11 whichever is later. These records shall be stored in Orange County, unless CONTRACTOR 27 12 requests and COUNTY provides written approval for the right to store the records in another 28 13 county. Notwithstanding anything to the contrary, upon termination of this Agreement, 1 14 CONTRACTOR shall relinquish control with respect to COUNTY data to COUNTY in 2 15 accordance with Subparagraph 39.240.3. 3 23.2.3 16 25.2.3 COUNTY may refuse payment for a claim if client records are determined 4 17 by COUNTY to be incomplete or inaccurate. In the event client records are determined to be 5 18 incomplete or inaccurate after payment has been made, COUNTY may treat such payment as an 6 19 overpayment within the provisions of this Agreement.
