Common use of CLOSING TIME OF PERFORMANCE Clause in Contracts

CLOSING TIME OF PERFORMANCE. The EMPLOYER agrees that in the event a performance shall conclude after 11:00 P.M. or if the performance exceeds three (3) hours in length from actual Curtain Time, as determined by the Stage Manager, each performing ARTIST shall be compensated at the Overtime Rate for each quarter- hour or fraction thereof. However, if the conclusion of the performance was delayed by circumstances outlined in Paragraph 56 (Force Majeure or similar circumstances), the EMPLOYER shall not be liable for such Overtime compensation.

CLOSING TIME OF PERFORMANCE. The EMPLOYER agrees that in the event a performance shall conclude be concluded after 11:00 P.M. 11:30 p.m. or if the performance exceeds three (3) hours in length from actual Curtain Time, as determined by the Stage Manager, each performing ARTIST shall be compensated at the rate of one-half (1/2) the hourly Overtime Rate for each quarter- half-hour (1/2) or fraction thereof. However, if the conclusion of the performance was delayed by circumstances outlined in Paragraph 56 35 (Force Majeure or similar circumstances), the EMPLOYER shall not be liable for such Overtime compensationthe compensation outlined above.
