Common use of Co-Location Clause in Contracts

Co-Location. Each Party shall ensure that major suppliers in its territory provide to facilities-based suppliers, licensed in its territory, of the other Party physical co-location of equipment necessary for interconnection or access to unbundled network elements in a timely fashion and on terms, conditions, and cost-oriented rates that are reasonable, transparent, and non-discriminatory.

Each Party shall ensure that major suppliers in its territory provide to facilities-based suppliers, licensed in its territory, suppliers of public telecommunications networks or services of the other Party physical co-location of equipment necessary for interconnection or access to unbundled network elements in a timely fashion and on terms, conditions, terms and cost-oriented rates conditions that are reasonable, transparent, reasonable and non-discriminatorydiscrimina­ tory. (28) The maintenance of appropriate measures includes the effective enforcement of such measures.
