Common use of Commitment to Training and Careers Clause in Contracts

Commitment to Training and Careers. (a) The parties commit themselves to continuing and upgrading the training provided to employees. It is agreed that the parties will co-operate in ensuring that training is maintained and improved. This training will form the basis of an enhanced career structure in the industry. (b) If the Employer requires the employee to undertake an off the job National Accredited training course, the employee will be paid ordinary rates of pay for any hours spent at such training outside of their ordinary hours of work. Hours spent in training for disciplinary purposes may be paid at the ordinary level 1 rate of pay. Where the employer offers training to employees and such training is completed and its associated costs, and such training is likely to be useful to the employee in obtaining employment with another employer, the employee must repay an amount according to the following formula if s/he resigns the employment before completing 12 months employment; Number of weeks remaining before completing 12 months employment divided by 52 multiplied by the cost of the training or $ 1000, whichever is lesser. E.g. where the course cost is $800 and the employee resigns 13 weeks before completing 12 months service, the employee must repay $200.
