Common use of Communications by email Clause in Contracts

Communications by email. Subject to clause 18.7, if a communication is emailed, a delivery confirmation report received by the sender, which records the time that the email was delivered to the addressee’s last notified email address is prima facie evidence of its receipt by the addressee, unless the sender receives a delivery failure notification indicating that the electronic mail has not been delivered to the addressee or an “out of office” notification.
