The Park County will not reimburse the Assisted Business for any costs incurred prior to January 10August 27, 20182017, nor for any expenses not included in the approved budget or not clearly and accurately supported by the Assisted Business’s records. a) The Process Park County will authorize the Assisted Business to draw up to $170,000 against the funding reserved for reimbursement the Assisted Business by the Department. In drawing against the reserved amount, the Assisted Business shall follow the instructions supplied by Park County. Unless otherwise authorized by Park County, the Assisted Business may receive grant funds periodically over the Contract period only upon documenting the expenditure of the Assisted Business’s required matching funds and the creation of the eligible costs and expenses shall be as follows:
i) The Assisted Business will request reimbursement from the County or its representative net new jobs by submitting all information set forth in Section 3: REPORTING of this contract.
ii) Within ten business days of receiving a complete request for reimbursement from the Assisted Business, and after incurring eligible expenses. Upon reasonable request, the Assisted Business shall provide substantiation of its investment in capital in excess of the required $170,000 new investment at the project site.
b) If Park County determines that the Assisted Business has failed to satisfactorily carry out the duties and responsibilities under the Contract, the Department may revoke the Assisted Business's ability to access additional funds until such time as Park County and the Assisted Business agree on a plan to remedy the deficiency.
c) The Assisted Business agrees that if the local government or tribal government request the funds before the jobs are created, and the Department agrees to that request, the Assisted Business receiving BSTF financial assistance is liable to Park County for the full amount of the award that is advanced by the Department, if the Assisted Business:
a. Fails to create or maintain the number of net new eligible jobs as specified in the executed contract and assistance agreement, or
b. Fails to inject the required amount of match into the project as specified in the executed contract and assistance agreement. Additionally the Department may recapture funds if:
a. At the end of the contract period the Department has overpaid based on those documents, the number of net new jobs at the end of the contract period.
b. The business ceases operations at the Project Site within the contract period.
d) Park County reserves the right to withdraw a commitment for any BSTF funds which remain un-disbursed at Contract closeout or its representative will submit a pre-approval Request at the end of the Contract period.
e) The Assisted Business certifies that no request for Payment reimbursement submitted for eligible expenses under this Contract shall duplicate any expense submitted to the Department for reimbursement under any other program administered by the Department.
iiif) After pre-approval is granted, the County will submit a final Request for Payment to the Department.
iv) The County or its representative will then reimburse If the Assisted Business creates an eligible new job but fails to sustain that job for the full requisite duration, then the Assisted Business shall reimburse Park County all funds received for that job. If the Assisted Business fails to create the required number of jobs, then the Assisted Business shall reimburse Park County the difference between the total amount received advanced and the amount attributable to actual jobs created. If the Assisted Business ceases operation at the Project Site, then the Assisted Business shall reimburse Park County all funds received.
g) The Assisted Business may not use monies provided through this Contract as payment for Porject costs that are reimbursed from other sources.
h) Park County will withhold ten percent (10%) of the total amount awarded to the Assisted Business until the Department for each eligible expense submitted approves the complete purchase of equipment, construction material, software and wage reimbursement and all tasks are completed by the Assisted Business and approved by the Department. The Assisted Business acknowledges and understands that reimbursement as described above is contingent and dependent upon proper and timely completion of the Project, timely submittal of all required documentation, timely reporting as set forth in Section 3, approval by the Department of all reimbursement payments, and compliance with all terms and conditions hereunder.

b) If the City determines that the Assisted Business has failed to satisfactorily carry out the duties and responsibilities under the Contract, the Department may revoke the Assisted Business's authority to draw against the reserved amount described herein until such time as the City and the Assisted Business agree on a pre-approval Request for Payment plan to remedy the deficiency.
c) The Assisted Business agrees that if it ceases operations at the Project Site during the Contract period the Assisted Business shall immediately reimburse the entire amount of the grant advanced up to that time to the Department. If the Assisted Business does not create the projected number of net new positions that meet BSTF program eligibility requirements, the Assisted Business agrees that it shall reimburse the City a prorated portion of any BSTF funds advanced based on documentation of the actual eligible net new positions created by the Assisted Business.
iiid) After preThe City reserves the right to withdraw a commitment for any BSTF funds which remain un-approval is granted, disbursed at Contract closeout or at the County will submit a final Request end of the Contract period.

d) The County reserves the right to withdraw a precommitment for any BSTF funds that remain un-approval Request disbursed at Contract closeout or at the end of the Contract period.

i) A new job to the company that was created or filled on or after January 10position employs an individual, 2018;
ii) Have at a minimum, an average of thirty-five (35) working hours per week on an annual basis; and
iii) The job , that was hired on or after October 31, 2011, and pays wages that meet or exceed $18.99 per 16.31per hour, including the value of employee benefits that meet the requirements of the Employee Retirement Income Security Act of 1974, 29 U.S.C. 1001, et seqexcluding benefits. The County City will not reimburse the Assisted Business for any costs incurred prior to January 10October 31, 20182011, nor for any expenses not included in the approved budget or not clearly and accurately supported by the Assisted Business’s records. The Assisted Business shall satisfy the matching funds requirements consistent with the purposes expressed in the CountyCity’s application during the period of the Contract and shall meet or exceed the 1:2 required match ratio.
a) The Process City will authorize the Assisted Business to draw up to $178,125 against the funding reserved for reimbursement the Assisted Business by the Department. In drawing against the reserved amount, the Assisted Business shall follow the instructions supplied by the City. Unless otherwise authorized by the City, the Assisted Business may receive grant funds periodically over the Contract period only upon documenting the expenditure of the Assisted Business’s required matching funds and the creation of the eligible costs and expenses shall be as follows:
i) The Assisted Business will request reimbursement from the County or its representative net new positions by submitting all information set forth in Section 3: REPORTING of this contract.
ii) Within ten business days of receiving a complete request for reimbursement from the Assisted Business, and based on those documentsafter incurring eligible expenses. Upon reasonable request, the County or Assisted Business shall provide substantiation of its representative will submit investment in capital in excess of the required $89,062.50 new investment at the project site.
b) If the City determines that the Assisted Business has failed to satisfactorily carry out the duties and responsibilities under the Contract, the Department may revoke the Assisted Business's authority to draw against the reserved amount described herein until such time as the City and the Assisted Business agree on a pre-approval Request for Payment plan to remedy the deficiency.
c) The Assisted Business agrees that if it ceases operations at the Project Site during the Contract period the Assisted Business shall immediately reimburse the entire amount of the grant advanced up to that time to the Department. If the Assisted Business does not create the projected number of net new positions that meet BSTF program eligibility requirements, the Assisted Business agrees that it shall reimburse the City a prorated portion of any BSTF funds advanced based on documentation of the actual eligible net new positions created by the Assisted Business.
iiid) After preThe City reserves the right to withdraw a commitment for any BSTF funds which remain un-approval is granted, disbursed at Contract closeout or at the County will submit a final Request end of the Contract period.
e) The Assisted Business certifies that no request for Payment reimbursement submitted for eligible expenses under this Contract shall duplicate any expense submitted to the Department for reimbursement under any other program administered by the Department.
iv) The County or its representative will then reimburse the Assisted Business the full amount received from the Department for each eligible expense submitted and approved by the Department. The Assisted Business acknowledges and understands that reimbursement as described above is contingent and dependent upon proper and timely completion of the Project, timely submittal of all required documentation, timely reporting as set forth in Section 3, approval by the Department of all reimbursement payments, and compliance with all terms and conditions hereunder.

COMPENSATION AND CONSIDERATION. The total amount to be reimbursed awarded to the Assisted Business Contractor under the Contract shall be up to $7,242.00 7,500.00 for the (24) jobs that pay at or above the Ravalli County Current Average Wage per eligible net new job created by the Assisted Business for documented costs with reimbursement not to exceed a total of
a) of $180,000 dollars for the entire Contract. An eligible net new job is defined as the following:
i) A one that is new job to the company that was created or and has not been filled on or after January 10before August 1, 2018;
ii) Have at 2017. Eligible new job criteria is a minimumfull-time job, meaning a predominantly year-round position requiring an average of thirty-five (35) working 35 hours per week on an annual basis; and
iii) The job of work each week, and pays wages that meet or exceed $18.99 16.24 per hour, including the value of employee benefits that meet the requirements of the Employee Retirement Income Security Act of 1974, 29 U.S.C. 1001, et seq. excluding benefits.. The County will not reimburse the Assisted Business for any costs incurred prior to January 10August 1, 20182017, nor for any expenses not included in the approved budget or not clearly and accurately supported by the Assisted Business’s ’ records. The Assisted Business shall satisfy the matching funds requirements consistent with the purposes expressed in the County’s application during the period of the Contract and shall meet or exceed the 1:2 $1 for every $2 of BSTF financial assistance received required match ratio.
a) The Process County will authorize the Assisted Business to draw up to $171,000 (total award minus grant administration) against the funding reserved for reimbursement the Assisted Business by the Department. In drawing against the reserved amount, the Assisted Business shall follow the instructions supplied by the County. Unless otherwise authorized by the County, the Assisted Business may receive grant funds periodically over the Contract period only upon documenting the expenditure of the Assisted Business’s required matching funds and the creation of the eligible costs and expenses shall be as follows:
i) The Assisted Business will request reimbursement from the County or its representative net new positions by submitting all information set forth in Section 3: REPORTING of this contract.
ii) Within ten business days of receiving a complete request for reimbursement from the Assisted Business, and based on those documentsafter incurring eligible expenses. Upon reasonable request, the Assisted Business shall provide substantiation of its investment in capital in excess of the required $90,000 (Match amount) new investment at the project site.
b) If the County determines that the Assisted Business has failed to satisfactorily carry out the duties and responsibilities under the Contract, the Department may revoke the Assisted Business' authority to draw against the reserved amount described herein until such time as the County and the Assisted Business agree on a plan to remedy the deficiency.
c) In the event that the County must reimburse the Department ANY amount by reason of the Assisted Business ceasing operations at the Project Site during the Contract period OR the Assisted Business failing or its representative will submit refusing to create the projected number of net new positions that meet BSTF program eligibility requirements OR the Assisted Business failing or refusing to perform any requirement for funding eligibility or any obligation incurred by it under the Assistance Agreement, then and in those events, or any one of them, the Assisted Business agrees and promises that it shall reimburse the County any and all such amounts, including all related expenses and fees, within 30 days of receipt of written notice from the County.
d) The County reserves the right to withdraw a precommitment for any BSTF funds that remain un-approval Request disbursed at Contract closeout or at the end of the Contract period.
e) The Assisted Business certifies that no request for Payment reimbursement submitted for eligible expenses under this Contract shall duplicate any expense submitted to the Department for reimbursement under any other program administered by the Department.
iii) After pre-approval is granted, the County will submit a final Request for Payment to the Department.
ivf) The County or its representative will then request funds from MDOC with which to reimburse the Assisted Business periodically over the full amount received from Contract period only upon documenting the Department for each expenditure of the required matching funds and the creation of the eligible expense submitted and approved net new jobs by the Department. The Assisted Business acknowledges and understands that reimbursement as described above is contingent and dependent upon proper and timely completion of the Project, timely submittal of all required documentation, timely reporting as set forth in Section 3, approval by the Department of all reimbursement paymentsBusiness, and compliance with all terms and conditions hereunderafter incurring eligible expenses.
