Compensation for Transit Traffic. 4.1 Transit traffic is Local Traffic exchanged between the Parties that originates or terminates on the network of another telecommunication service provider (the “Non-Party Provider”), where one of the Parties or the Non-Party Provider performs a local tandem function to complete the traffic between the others. When the transit function is performed by one of the Party’s the following shall be applicable: 4.1.1 Prior to either Party providing transit traffic services to the other, the Party requesting transit service must provide notice to the other Party. 4.1.2 Each Party represents that it will not send Local Traffic to the other Party that is destined for the network of a Non-Party Provider. 4.1.3 The Party originating traffic will compensate the other Party a Local Transit Traffic rate element of $.003per Minute Of Usage (MOU). 4.2 All traffic, other than Local Traffic, that transits a tandem will be classified and treated as Meet- Point Billing Traffic, unless otherwise agreed in writing between the Parties.
Compensation for Transit Traffic. 4.1 Windstream shall provide tandem switching and transport services for Dialog Telecommunications-originated Transit Traffic where Windstream has agreed to provide Transit Traffic Services. Windstream shall bill Dialog Telecommunications for Transit Traffic originated by Dialog Telecommunications at the rates as set forth in Appendix B: Price List. The Parties agree that Transit Traffic Services are not a 251 requirement pursuant to federal law and are voluntarily being provided by Windstream to Dialog Telecommunications. 4.2 Windstream agrees to provide, where available, industry standard Exchange Message Interface (EMI) call detail records associated with Transit Traffic sufficient for billing purposes within forty-five (45) days after such usage occurs. So long as Dialog Telecommunications routes its Transit Traffic destined for Third Party Terminating Carriers in accordance with the LERG and this Agreement, Windstream agrees to deliver Dialog Telecommunications-originated Transit Traffic to the Third Party Terminating Carriers to the extent the Third Party Terminating Carriers are interconnected with Windstream’s tandem and Windstream is not prohibited from delivering such traffic to such Third Party Terminating Carriers. So long as Third Party Originating Carriers properly route their Transit Traffic destined for Dialog Telecommunications in accordance with the LERG and in accordance with terms and conditions of an applicable Windstream tariff or a written agreement with Windstream for Transit Traffic Service, Windstream agrees to deliver Transit Traffic originated by a Third Party Originating Carrier to Dialog Telecommunications. Notwithstanding the foregoing, Dialog Telecommunications and any third parties are responsible for negotiating and executing any appropriate contractual arrangements between themselves for the exchange of Transit Traffic through the Windstream network. Windstream will not be liable for any compensation to the Third Party Terminating Carriers for Dialog Telecommunications- originated Transit Traffic. If ALLTEL or TCG performs the local tandem function, the following shall be applicable: 4.1.1 Prior to either Party providing transit traffic services to the other, the Party requesting transit service must provide notice to the other Party. 4.1.2 Party represents that it will not send Local Traffic to the other Party that is destined for the network of a Non-Party Provider unless and until such Party has the authority to exchange traffic with the Non-Party Provider. 4.1.3 The Party originating traffic will compensate the other Party a Local Transit Traffic rate element of $.00147 per Minute Of Usage (MOU). 4.2 All traffic, other than Local Traffic, that transits a tandem will be classified and treated as Meet- Point Billing Traffic, unless otherwise agreed in writing between the Parties.

In the event one Party originates traffic that transits the second Party’s network to reach a third party Telecommunications Carrier with whom the originating Party does not have traffic exchange agreement, then the originating Party will indemnify, defend and hold harmless the second Party against any and all charges levied by such third party Telecommunicaitons Carrier. 4.1.3 The Party originating traffic will compensate the other Party a Local Transit Traffic rate element of $.003 per Minute Of Usage (MOU). 4.2 All traffic, other than Local Traffic, that transits a tandem will be classified and treated as Meet- Point Billing Traffic, unless otherwise agreed in writing between the Parties.
Compensation for Transit Traffic. Neutral Tandem agrees to accept Transiting Traffic from Sprint and deliver such Transiting Traffic to third parties interconnected with the Neutral Tandem tandem (“Transit Service”). Neutral Tandem shall provide Sprint Transit Service pursuant to the applicable Neutral Tandem tariffs, but in the case of any inconsistency, this Agreement, including the attached Pricing Schedules, shall take precedence over any applicable tariff. Each Party acknowledges Sprint shall pay Neutral Tandem a transit service charge as set forth in the Pricing Schedule attached hereto for traffic originated by Sprint and delivered to Neutral Tandem for transport to a third party carrier interconnected to the Neutral Tandem tandem. As the Parties agree to a Pricing Schedule for additional markets, those will be added to and be part of this Agreement. Sprint shall not be responsible, and Neutral Tandem shall not ▇▇▇▇ Sprint, for Transit Traffic originated by third party carriers interconnected to Neutral Tandem’s tandem facilities and delivered to Sprint.

  • Developer Compensation for Emergency Services If, during an Emergency State, the Developer provides services at the request or direction of the NYISO or Connecting Transmission Owner, the Developer will be compensated for such services in accordance with the NYISO Services Tariff.
